18.9.4 The City will maintain contributions for the employee's health benefits under <br />group health plans at the same level as prior to the leave, in accordance with the <br />Family & Medical Leave Act. The employee may return to the same position, <br />or another position with equivalent benefits, pay and other terms and conditions <br />of employment upon completion of the leave. <br />18.10 Court Appearance Leave <br />Leave for court appearance shall be granted by the City for court appearance on behalf of <br />the City with no loss of salary. <br />18.11 Personal Business Leave <br />18.11.1 An employee shall be entitled to a maximum of two (2) days per year for <br />Personal Business Leave for any reason without loss of pay. Such leave shall be <br />deducted from accrued sick leave. <br />18.11.2 An employee must secure advance permission for all Personal Business Leave as <br />defined above, and shall normally notify the department head two (2) days <br />before taking this leave, unless any emergency exists which prohibits the <br />employee from providing such advance notice. <br />ARTICLE 19 <br />HEALTH PLANS <br />19.1 Health and Cafeteria Plans <br />19.1.1 The City agrees to contract with the California Public Employee's Retirement <br />System (PERS) for participation under the Public Employees Medical and <br />Hospital Care Act (Government Code Section 22751, et, seq.), pursuant <br />specifically to Government Code Section 22825 and 22850. <br />19.1.2 For the period October 1, 2001, through September 30, 2004, the City's <br />maximum contribution for each active employee for a Health Benefit Plan (as <br />referenced in Government Code 22825) shall not exceed sixteen dollars <br />($16.00) per month. <br />19.1.3 The health plans offered shall be those of the California Public Employee's <br />Retirement System (PERS) <br />
