Oral Communications a. (continued) <br />Community Development Director Pawloski indicated the location of the new <br />private storm drainage system and described how it is expected to function. <br />Mr. Pawloski said the City will not grant occupancy permits unless it is <br />satisfied that all lots are properly graded for drainage. In response to <br />question, Mr. Pawloski said that if the new residents landscape their yards <br />so that drainage is blocked, they will flood their own property. <br />B.F. Willis, 1787 Kansas Street, said he is concerned the new property owner <br />behind him will block drainage. <br />In response to question, Mr. Pawloski said that the engineer for the <br />developer who prepared the subdivision plans also prepared the drainage <br />plans which were checked by the City's engineering staff. He said an error <br />was found in the original grading which has been corrected. <br />City Attorney Schricker stated for the record that there is no legal duty of <br />the City to guarantee adequate drainage between private properties and that <br />anyone who diverts water on to other properties is liable for action against <br />him. Mr. Schricker stated that the owners of the new lots have an obligation <br />to maintain grading and not change the drainage, observing that it is a civil <br />matter between neighbors. <br />Scott Ward, The Plymouth Group, Mountain View, developer of the Sycamore <br />Street property, said that there is a deed restriction on each lot which <br />clearly specifies the responsibility of the homeowner to maintain the private <br />storm drain. Mr. Scott said his organization also provides a "new homeowner <br />package" which states the deed restriction clearly. He agreed to give copies <br />of the homeowner materials to Mrs. Collier to share with her neighbors. <br />Evelyn Willis, 1787 Kansas Street, asked about construction of fences or <br />walls that may block water flow. Mr. Ward said that any configuration which <br />has a negative effect on storm drain flow is prohibited. <br />---------------------------------------- - - - - -- <br />MATTERS OF COUNCIL INTEREST <br />a.
