<br /> accordance with the Tenant's Plans (to the extent applicable): <br /> (a) The work identified as "Tenant's Work - Description" on Exhibit D-5 <br /> attached hereto. Tenant shall be permitted, without charge, to tie into Landlord's Fire <br /> Protection System for the Building. <br /> (b) The installation of Tenant's FF&E. <br /> Without limiting the generality of the foregoing, Tenant shall perform Tenant's Work in a <br /> good and workmanlike manner and in full compliance with all Applicable Laws. All of Tenant's <br /> Work shall be performed under contracts made by and in the name of Ten ant. <br /> ARTICLE V <br /> PERFORMANCE OF WORK <br /> Section 5.1. Contractors. Thirty (30) days or more prior to the commencement of the <br /> construction of their respective improvements, Tenant and Landlord shall each submit the name <br /> of its proposed general contractor to the other party. <br /> Section 5.2. Manner of Construction. Landlord (with respect to Landlord's Work) and <br /> Tenant (with respect to Tenant's Work) each represents and warrants to the other that it has <br /> performed or shall perform its construction obligations under this Work Letter in a good and <br /> workmanlike, first-class manner, consistent with other similar developments in the region and in <br /> full compliance with all Applicable Laws. <br /> Section 5.3. Insurance. In addition to the insurance requirements set forth in the Lease, <br /> Tenant and Landlord with respect to work to be performed hereunder shall comply with the <br /> following requirements: <br /> (a) General Covera2es. The contractors and all of their subcontractors shall <br /> carry worker's compensation insurance covering all of their respective employees, and <br /> shall also carry commercial liability insurance, including property damage, all with <br /> limits, in form and with companies as are required to be carried by Tenant as set forth in <br /> the Lease. <br /> (b) General Terms. Certificates for all insurance carried pursuant to the <br /> foregoing sections shall be delivered to the other party before the commencement of <br /> construction of the improvements and before the contractor's equipment is moved onto <br /> the site. Contractor shall maintain all of the foregoing insurance coverage in force until <br /> the improvements are fully completed. <br /> Section 5.4. Construction Warranties. If available at no additional cost, Landlord and <br /> Tenant shall obtain all standard warranties from the contractors for their respective work to be <br /> performed hereunder and hereby agree, to the extent available at no additional cost, to obtain <br /> such warranties so that they are designated to benefit Landlord and Tenant. <br /> . -.."......-. <br />
