<br /> repaving or re-striping the Parking Facility, or resurfacing or repainting any interior mall <br /> during a S~asonal Period. <br /> (g) Parking Facilitv. etc. Throughout the Term, Landlord shall maintain or <br /> cause the City (or the City's successor) to maintain the Parking Facility and the <br /> sidewalks, hardscape lighting and landscaping within Block One, in a first-class, safe, <br /> clean and secure condition, without cost or expense to Tenant or Tenant's employees, <br /> patrons and invitees (subject however, to Landlord's rights and Tenant's obligations <br /> hereunder with respect to Common Area Expenses). To the greatest extent practicable, <br /> the maintenance of the Parking Facility and such other facilities shall include, without <br /> limitation: <br /> 1. Maintenance commensurate with the standards of maintenance applicable <br /> ".,;. to parking facilities and other outdoor facilities at or serving other <br /> <, first-class shopping centers in the Metropolitan Area such as, without" <br /> limitation, the standards of maintenance applicable as of the date of this <br /> Lease to the parking facilities and other outdoor facilities at the <br /> "Broadway Pointe" shopping center in Walnut Creek, California; <br /> 2. Keeping the Parking Facility well lit, manned and secure during all normal <br /> business hours of Tenant and at least from two (2) hours before the <br /> opening of Tenant's business at the Premises each day to two (2) hours <br /> after the end of the last film shown at the Premises each day; <br /> 3. Regular inspection and maintenance and, as needed, repaIr and <br /> replacement of the roof, walls, foundations, structural elements, utilities, <br /> corridors, stairways, walkways and vertical transportation systems thereof <br /> and the sidewalks, hardscape, lighting and landscaping within Block One; <br /> 4. Periodic re-striping of all parking areas within the Parking Facility and <br /> periodic re-painting of all painted surfaces within the Parking Facility; <br /> 5. Prompt removal of all papers, debris, filth, and refuse, from the sidewalks, <br /> hardscape, lighting and landscaping within Block One; and <br /> 6. Installation, maintenance and, as appropriate, repair and replacement of <br /> directional and informational signage within the Parking Facility. <br /> Landlord shall use all commercially reasonable efforts to cause the City to so maintain <br /> the Parking Facility and other facilities, including (without limitation), if the City's <br /> failure to maintain the Parking Facility is material and is not cured within fifteen (15) <br /> days after notice thereof from Landlord or Tenant, institution and diligent prosecution of <br /> legal proèeedings to enforce the agreement of the City to maintain the Parking Facility. <br /> " <br /> 38 <br /> CHG02:3091375.v8 <br /> . ._.,......~.. <br />
