Motion ! <br />carried. <br />Communication and I,Iap was received from the Southern Pacific Company in regards to the <br />raising of Brewster Ave. and Spruce Street crossings, was on motion of Councilman Thorning, <br />seconded by Councilman Hildebrand, said communication and map be referred to the City Manag- <br />er and City Engineer. Motion carried. <br />A petition was received by the Council asking for street impro':ement on certain portion <br />of Del Ora Ave. waz on motion of Councilman Slafford, seconded by Councilman Dusel, same be <br />referred to the School Board, the City Engineer and City Manager. Motion carried. <br />Councilman Stafford offers the fol owing Resolution and moves its adoption. Council- <br />man Dusel, seconds the motion. Motion carried. <br />RESOLUTION OVERRULING PROTESTS AGAINST ASSESSMENT UNDER <br />RESOLUTION OF INTENTION NO.1-19 AND CONFIRMING THE <br />AS SES S14EN T <br />WHEREAS, the Council of the Town of Redwood City did, on the 4th day of February, 1929, <br />pass and adopt Resolution of Intention No. L-1 to order the doing of certain work and im- <br />provements set forth and described in said _tesolution of Intention No. L-1, which is now on <br />file in the office of the Clerk of the City of Redwood City and to which reference is hereby <br />made for a description of said work and improvements, the assessment district benefitted by. <br />said work and improvements and to be assessed to pay the costs, expenses and damages thereof <br />and for further particulars.; and <br />WHEREAS, notices of the passage of said Resolution of fntenti)n No. L-1 were duly and <br />legally posted and published, as required by law, as appears from the affidavits of C. L. <br />Dimmitt, Street Superintendent and Sam H. Winklebleck, now on file in the office of the <br />Clerk of the City of Redwood City; and <br />'WHEREAS, within the time allowed by law when interested persons could object to said <br />work and improvements described in said Resolution of Intention No. L-1 or to the extent of <br />the district to be assessed therefor no protests or objections of any kind were made or <br />filed with the Clerk of said City of Redwood City; and <br />WHEREAS, said Council of the City of Redwood City did thereupon acquire jurisdiction to <br />proceed in said matter and did thereupon pass and ad pt a resolution offering the work and <br />improvements described in said Resolution of Intention No. L-1 and did in said Resolution <br />appoint L. A. Heiner, Walter T. Kellogg and Edwin B. Fox as Commissioners to assess benefits <br />and damages and have general supervision of the work and improvements described in said <br />Resolution of Intention No. L-1 until the completion thereof; and <br />WHEREAS, said above named Commissioners duly qualified as such as provided by law; and <br />WHEREAS, said Commissioners did, on the 8th day of August, 19299 make a written report <br />to the Council of the City of Redwood City, which report was accompanied by a plat of the <br />assessment district showing the lands to be taken for the work and improvements described <br />in said Resolution of Intention No.1-1 and the lands assessed therefor and showing the re - <br />lative location of each district, block lot or portion of lot, and its dimensions, so far <br />C1 <br />
