MINUTES OF REGULAR MEETING REIVOOD CITY COUNCIL AUGUST 18, 1930 S P.M. Upon roll Call, the following Were present: Councilmen Mayor D R Stafford, H A Beeger, W J Dusel, C J Hildebrant, P A McCarthy, G W McNulty, and City Clerk B E Myers, Absent: E. B. Hinman. Upon motion of Councilman Beeger, seconded by Councilman Dusel minutes as mailed Were approved. Dave L Walter asked permission of the Council to rearrange the two lots at the corner of Edgeerood Road and Oakdale to make them face on Edgewood rather than Oakdale. R L Bremner, Who had filed a formal protest, also made oral protest to creating a key lot of his property. A letter was also read from Mrs G S Rice Who lives across the street. After discussion, upon motion by Councilman McCarthy, seconded by Counoilman Beeger, the application Was denied subject to the right of renewal provided Mr Walter could obtain the consent of the protesting property owner. The Clerk was asked to read a letter, addressed to the Building Inspector, from the Sudden Lumber Company applying for permit to erect 'certain improvements" in accordance with plans submitted. A protest to this permit was filed and several supplemented the protest orally among whom were William Hohn, Chas. H. Holt, Rev. Cavanaugh, and Fire Chief Mark Ryan who in answer to questions pro- pounded to him by Councilman McCarthy indicated that a lumber yard there would be a fire hazard. Councilman Beeger expressed his opinion that a lumber yard there would greatly detract from the value of property in that block,and Councilman Dusel spoke for Ve Baird a property owner in that vicinity. Finally Upon motion of Councilman YOUlty, seconded by Councilman Hildebrant, the matter was referred to the Building Inspector to examine the plans and to make his recommendation as to what should be done to make them conform to the ordinance applying thereto. Mr. Ed. Scott, who stated he was representing certain property owners affected, precipitatgd the discussion concerning the elsotrolier lighting system on Broadway and Hopkins. Mr. Scott made the contention that according to the law applying, any and all protests should have been in writing and presented before eight o'clock on the night set for hearing and that any protests either written or oral thereafter would have no legal •eight whatsoever. Mr. A. Hess, Sr., who had circulated a protest petition, outlined his stand on the question, and he in turn was followed by Councilman McCarthy who emphasized the points made by Mr. Scott and submitted figures from the Engineer's Office showing total frontage and percentages of signatures on original petition and the protest petition. Counoilmsn Beeger spoke briefly on the matter as did B E Myers, who represented the Methodist Church. D L Walter also spoke. Finally, Councilman McCarthy, seconded by Councilman Hildebrant, offered Resolution over -ruling proteats,and moved its adoption, Upon Roll Call, Councilmen Hildebrant, McCarthy and Stafford voted "Yes" and Councilmen Beeger, Dusel and McNulty, voted "No" 0 Ur-
