<br />MINUTES OF REGULAR AWOURNED MEETING
<br />REi3VOOD CITY COUNCIL

<br />Upon roll call, the following were present: Councilmen Mayor D R Stafford, A A Beeger,
<br />W J Dusel, P A McCarthy, Geo. W. McNulty, City Clerk B E Myers. Absent: Council-
<br />man C. J. Hildebrant.
<br />On motion of Councilman McNulty, seconded by Councilman Dusel, approval of the minutes
<br />of the last meeting was dispensed with.
<br />The City Attorney presented affidavits of posting and publication in connection with
<br />the tree planting project, Resolution 19-15, and same were filed on motion of
<br />Councilman McNulty, seconded by Councilman Dusel. Several protests were read
<br />by the Clerk and upon motion of Councilman llcPiulty, seconded by Councilman Hihman,
<br />they were ordered received and filed. After discussion, Councilman McCarthy,
<br />seconded by Councilman Hinman, offered the following resolution over -ruling the
<br />protests and ordering the work in accordance with the original Resolution of
<br />Intention:
<br />RESOLUTION OVERRULING PROTESTS AND OBJECTIONS UNDER RESOL-
<br />UTION OF INTENTION NO. M-15 AND CONFIRMING THE -REPORT
<br />OF THE CITY ENGINEER FILED rnBarjuiaurat.
<br />WHEREAS, the Council of the City of Redwood City did on the
<br />6th day of October, 19300 pass and adopt Resolution of Intention NO.
<br />11-15, which is now on file in the office of the Clef;.k of the City of
<br />Redwood City, and to sihich-refereiice is hereby made for a description
<br />of the work therein ordered and herein referred to, and
<br />WBEREAS'in and by said Resolution of Intention said Council
<br />further ordered that all'the improvements proposed therein be referred
<br />to C.L. Dimmitt; City Engineer of said City of Redwood City, for the
<br />purpose of making'a report therein in writing, as required by that
<br />certain act of'the Legislature of the State of California entitled
<br />"An Act to Provide'for the'Planting, Protection, Maintenance, Re-moval
<br />and change'of Trees, Shrubs, Plants and Gras's along and in Public
<br />Streets, Avenues, Lanes; Alleys,"Courts,'Places ind-Patinrays within
<br />Municipalities, and Providing a method for'the Assessment of the Costs
<br />and Expenses thereof", approved June 11, 1913, togeher with amendments
<br />thereto, and
<br />AREAS, said C.L. Dimmitt, City Engineer, did on the 15th day
<br />of December, 1930, file with said Council of the City of Rechvood City
<br />his said report in writing, as required by the provisions of the afore-
<br />mentioned act, and
<br />WHEREAS, said Council of the City of Redwood City examined said
<br />report and was satisfied with same, and did on said 15th day of Decem-
<br />ber, 1930, pass and adopt a resolution fixing Monday, the 12th day of
<br />January, 1931; at the hour of 7:30 o'clock P.M. of said day, at the
<br />City Hall in said•City of Redwood City, as the time and place for hear-
<br />ing of said protests against said Resolution of Intention and against
<br />said report; and
<br />WHEREAS, notices of the passage of said Resolution of Intention
<br />and the filing of said report were duly made and given, as required
<br />by law, as appears from the affidavits of B.E. Myers, City Clerk, and
<br />H.L. Winter, and L.C. Benning, now on file in the office of the Clerk
<br />of the City of Redwood City, and
<br />WHEREAS, within the time allowed by lau, certain persons interested
<br />and objecting to said'i.mprovements and the proposed assessment district
<br />provided in the report of the City Engineer, referred to herein, did
<br />file written protests with the Clerk of the City Council of the City of
<br />Redwood City, and
<br />WHEREAS, said C1ork dial endorse upon said protests the date of
<br />and reeeiption by him and dict present the same to the Council of the City
<br />of Redwood City for consideration at the time herotofore fixed by said
<br />Council for the hearing of said protests, and this being the time here-
<br />tofore fixed for hearing protests against the work provided for in said
<br />Resolution of InL•ention Pio. 11-15 and against tho report of the City
<br />Engineer filed thereunder, said Council proceeded to hear and consider
<br />all protests received and filed with said Clerk, and after having fully
