is <br />was finally decided, on motion of Councilman McCarthy, seconded by Councilman <br />Fletcher, that the matter be left in the hands of the City Manager with instruc- <br />tions that he grant a permit when he was assured that in moving and repairing this <br />building at the new location that the minimum building requirements would be met. <br />In connection with the title to the cemetery, the City Attorney reported receiving a <br />letter from the office of the Attorney General reading as follows: <br />"This will confirm the oral opinion expressed to you on your <br />visit to this office a few days ago to the effect that under the <br />charter of the City of Redwood City, Paragraph numbered 10 of <br />Section 3, defining the powers of Redwood City, by and through <br />its council and other officials, said city has the authority to <br />'***maintain cemeteries situated within or without the <br />limits of said cityf. <br />The charter provision referred to will be found in Statutes <br />of 1929, page 2181. <br />In correspondence with you I have heretofore cited Section <br />3105 of the Political Code which declares that <br />'The title to lands used as a public cemetery or grave- <br />yard, situated in or near to any city, *** and used <br />by the inhabitants thereof continuously, without inter- <br />raption, as a burial -ground for five years, is vested <br />in the inhabitants of such city, *** and the lands <br />must not be used for any other purpose than a public <br />cemetery. <br />You inform me that the cemetery in question is still being <br />used for burial proposes. Hence it is my view that both said <br />Section 3105 of the Political Code and paragraph 10 of $edtion <br />3 of your city charter are applicable and the city may expend <br />its funds for the maintenance of its cemetery." <br />5� <br />r I�r <br />dpi � A <br />. I <br />�len�r� <br />( R-� r hay e�a� <br />S1q�q �� on,°J ben <br />t��et� <br />$ <br />t' Y611 <br />Councilman McCarthy proposed that the Council adopt the opinion of the Attorney General <br />and the city assume ownership of Union Cemetery, that no permits for burial be given <br />except to families who already own plots in the cemetery, that this matter be entrusted <br />to the city health officer and if there be any doubt in his mind as to the ownership <br />of any of the plots, that he confer with the City Attorney, and also that no permit <br />be given for burials adjacent to the Woodside Road. Motion seconded by Councilman <br />Fletcher and carried. <br />Report was made concerning the building at Bradford and Middlefield. It was explained that <br />an old building had been taken down and that it might be best to continue the matter <br />further, so on motion of Councilman Anderson, seconded by Councilman McCarthy, the <br />matter was put over until March 6, 1939• <br />On motion of Councilman McCarthy, seconded by Councilman Anderson, the City Treasurer was <br />instructed that when the State Warrant now held by the city was paid that $7500 be <br />invested in U. S. Savings Bonds. <br />On motion of Councilman Fletcher, seconded by Councilman McCarthy, the Port Manager was <br />asked to have the dog owned by Mr. Cameron at the Yacht Harbor either put on leash or <br />inoculated. <br />The departmental reports were ordered filed. <br />
