23 <br />as provided for in Ordinance No. 333 of the City of Redwood City; and <br />WHEREAS, notice of filing of said assessment and of the time fixed <br />for hearing thereon was duly given by posting, publishing and mailing <br />as required by law, as appears from the affidavits of R. J. Clarke, <br />Albert Mansfield, and Bernice Gardner now on file in the office of the ! <br />Clerk of said City of Redwood City; and <br />WHEREAS, at the time and place last herein mentioned, no objections <br />of any kind were made against said assessments; and <br />WHEREAS, said Council of the City of Redwood City has now acquired <br />jurisdiction thereon: <br />THEREFORE BE IT RESOLVED by the Council of the City of Redwood City, ' <br />County of San Mateo, State of California, that the assessment above men- <br />tioned for street work done under Resolution of Intention No. 1940-1, <br />hereinbefore referred to herein, be and the same is hereby approved and <br />adopted and.the Superintendent of Streets of said City of Redwood City <br />is hereby directed to attach a warrant thereto and deliver same to the <br />contractor, as required by law.° <br />A letter was received from Lucius.H. Billings stating that on March 13, 1940, <br />he deposited with C. H. Holt the sum of $40 as a deposit for the purchase <br />of Lots 9, 10, 11, 12y 35, 36, 37 and 38, Block 2, Amended Map Resubdivision <br />of Lot 46, Reese Subdivision, for the sum of 0400. This money was never <br />turned into the City by Mr. Holt, and subsequently Mr. Billings repurchased <br />those lots for $400 and paid a deposit of 100 or $40 and requested that the <br />first X40 he had paid Holt and which was not turned into the city, be credited <br />to him on the purchase price of said lots. A motion was made by Councilman <br />Werder, seconded by Councilman Edmonds to give Mr. Billings credit for the <br />$40 paid to Mr. Holt and instructing the City Attorney to collect said <br />money from Mr. Holt. After discussion by the Council, the maker and second <br />of the motion withdrew the motion. <br />Communication was received from the City Manager stating that the San Carlos <br />Community Church had made application to hold a rummage sale in Redwood <br />City for two days, a Frid(ty.and Saturday sometime in December. On motion <br />of Councilman Edmonds, seconded by Councilman Granger, and carried, said <br />permission was granted. <br />A letter was received from the City Manager, C. L. Dimmitt, accompanied by a <br />letter to him from M. A. Grant, the County Engineer, stating that the <br />county was desirous of purchasing a piece of the O'Dea property fronting <br />on,Chestnut Street and adjoining the present corporation yard of the city, <br />and after a general discussion of the matter by the Council, the City <br />Manager was authorized to negotiate with the County for the sale of a <br />piece of said property of approximately 2.27 acres, the price, however, <br />to be not less than 0750 an acre, on motion of Councilman Werder, sec- <br />onded by Councilman Edmonds, and carried. <br />
