31 <br />In accord with the recommendation of the City Manager, following receipt of request <br />from the Frank J. Reilly Co. for an extension of 30 days to complete its contract <br />for the construction of the City Hall, 1991-F, resolution granting 30 days ex- <br />tension was unanimously adopted on motion of Councilman McCarthy, seconded by <br />Councilman Jones. <br />In accord with the recommendation of the City Manager, following receipt of request <br />from Miller Construction Co. for an extension of 30 days to complete its contract <br />for the construction of the Wharf and Warehouse, 1895-F, resolution granting 30 <br />days extension was unanimously adopted on motion of Councilman McCarthy, seconded <br />by Councilman Jones. <br />.Alfred Morton, recreational director, appeared -before the Council to request that the <br />new playground near 'Five Points be given a name, and he proposed that the name be <br />°The Herman Fleishman Playground", and it was so ordered on motion of Councilman <br />Pletcher, seconded by Councilman Jones. <br />The City Attorney reported that he had written Attorney Frank V. Kington to offer him <br />$3200 in full settlement of the Ruellan claim, but that Mr. Kington had replied <br />the plaintiffs had. refused to accept the offer. Mr. Mansfield was authorized, <br />therefore, to arrange with Mr. Kington a settlement of the case for the payment of <br />$3500 cash, on motion of Councilman McCarthy, seconded by Councilman Fletcher. <br />(Note: $3500 paid and Release secured) <br />There was considered application of Vernal C. Kelly and Fred Chaves for on sale distilled <br />spirits license at 2025 Broadway, a transfer from Louisa Francis. No protest was <br />ordered. Mr. Kelly was present and requested that he be permitted to establish <br />a beer garden or dancing pavilion with barbecue conveniences at the back of this <br />property on a space approximately 40 x 60 feet. On motion of Councilman Fletcher, <br />seconded by Councilman McCarthy, permit, revocable at the pleasure of the Council„ <br />was given with the understanding that week -day dancing cease at 10 P.M., Saturday <br />nights at 12, and no dancing Sundays. <br />John E. McCarthy, contractor, discussed before the Council the seeming confusion re- <br />lating to the 4 foot setback from property lines, especially where a fireplace <br />chimney extended from the side of the building. It was decided this should be <br />cleared up and the matter, therefore, was referred to the City Planning Commissipn. <br />A letter from the Carpenters Local requesting that a temporary baseball field be pro- <br />vided was referred to the Recreation Commission. <br />The request of the California Mission Trails Association for contribution of $150 toward <br />an advertising program was referred to the City Manager for possible inclusion in <br />the 1939-1940 budget. <br />On motion of Councilman McCarthy, seconded by Councilman Anderson, the Clerk was instructed <br />4 <br />
