Raines, 346 Grand Street, complained about the construction of a bungalow court <br />• by Mr. Hersey on Lots 3 and 4, Block 4, of Central Park. This matter had been <br />before the Council before, and it was generally agreed that the condition was <br />contrary to the provisions of the ordinance. It was finally decided, on motion <br />of Councilman McCarthy, seconded by Councilman Fletcher, that the matter be left <br />in charge of the City Manager with instructions that work be discontinued at <br />once and that no more construction be made until all provisions of the ordinance <br />were lived up to; that, if it were necessary, the city bring suit to enjoin the <br />owner from any more building contrary to these ordinances. <br />Mr. Pascul, representing the contractor doing the work on the Lincoln School audi- <br />torium, asked if it would be possible to waive the charge for the building permit. <br />.After considering the matter, on motion of Councilman McCarthy, seconded by <br />Councilman Fletcher, it was decided to deny the application. <br />Cuthbert Currie, representing interested property owners on King Street, asked the <br />Council to indicate to him by what right the -Council restricted the issuing of <br />building permits in Central Park so long as the application and the willingness <br />of the owner met all of the conditions of the ordinance. It was explained to <br />Mr. Currie that Mr. Nelson had made a similar request and that the City Attorney <br />had been asked to furnish a written decision covering the matter for the next <br />regular meeting. <br />The City Attorney submitted affidavit of the Street Superintendent showing posting <br />of Notice to Destroy Weeds, which was ordered filed. Following this, Council- <br />man Fletcher, seconded by Councilman McNulty, proposed the adoption of resolu- <br />tion requiring the abatement of nuisance (weeds). Carried. <br />The City Attorney submitted affidavit of C. L. Dimmitt showing that he had caused <br />to be posted notice of the passage of Ordinance of Intention No. 1939-1, which <br />affidavit was ordered filed. Whereupon, Councilman Anderson, seconded by Council- <br />man McNulty, proposed adoption of following resolution.
