e <br />Application for dance permit received from George Solari for Court Madrone, F. of A. <br />for dance to be held Saturday, December 25th until 100 A. M. and Friday, <br />December 31st until 2:00 A. 14. Councilman Britschgi moved, seconded by Council- <br />man, Fletcher, that permit be granted. ,Under the question, Councilman McNulty <br />questioned the 2:00 A.M. closing. Councilman Fletqher brought out the fact <br />a <br />that under the ordinance dances had to close at 14P00 A.M. Councilman Armstrong <br />asked the maker of the motion to amend motion to conform with the ordinance. <br />Mr. George Solari addressed the Council and asked that they grant the request <br />to dance until 2:00 A.M. He stressed the fact that it was a.special occasion <br />which happened only once a year and that it was hard to get musicians to play <br />on New Year's Eve if there were going to be an early closing. <br />Councilman Fletcher said he appreciated the fact that it was an occasion which <br />happened only once a year but if the request were granted, the Council would be <br />getting away from the rules of the ordinance, and that the Council cannot in- <br />variably make exceptions. <br />Councilman Britschgi withdrew his motion. Councilman Armstrong moved, Seconde(? <br />by Councilman Fletcher,. that permit be granted until 1:00 A.M. Under the <br />question, Councilman Britschgi asked if there was going to be someone to see <br />that the 1:00 A,11, closing was observed. Councilman McNulty.stated that he <br />believed the Foresters of America would close as they should and that it would <br />not be necessary to check on them. Councilman Britschgi said his idea was to <br />have one of the, Foresters see that the closing time was observed. Mayor Granger <br />said he believed there would be several ordinapees broken in the future and that <br />he believed an exception should be made. Councilman Fletcher commented that,, t <br />the Council had agreed not to break the terms of ordinances and believed no <br />exception should be made in this case. Councilman Armstrong stated he knew <br />the Foresters would not take advantage of any permit granted them but he be- <br />lieved all organizations should be treated similarly. Councilman Britschgi <br />asked if there were any exceptions to the ordinance and City Attorney McCarthy <br />stated there were none. Councilman McNulty stated that the agreement of the <br />Council was not to deviate from the terms of the ordinance. City Attorney <br />McCarthy read section of the ordinance.regarding time dances may be held. Moti)n <br />granting permit until,1:00 A.M, passed unanimously. <br />Councilman McNulty asked if the agreement>was that no dances -in -town - in- <br />vitational or otherwise - were to run after 1:00 A.M. It was -so agreed. <br />City Clerk R. S. Dodge read communication from Lieutenant Commander D.,McKnight of <br />. the 128th Naval Construction Battalion,, Camp Parks, California.- expressing <br />appreciation for, the o pportunity of leasing band instruments and enclosing <br />properly .executed lease. Communication and lease were ordered filed. <br />Affidavit of publication of ordinance rezoning Lot 7r Vera Avenue Villas was ordered <br />.1 <br />filed <br />on motion of Councilman Fletcher, seconded by Councilman Britschgi. <br />City Clerk R. S. Dodge read communication from the Planning Commission in which.they <br />advised that they had voted to request the City -Council to postpone action in <br />the matter of changing the limits of the existing fire zone in the vicinity of <br />lot 7, Block A, Vera Avenue Villas pending proposed changes in the zoning <br />ordinance. <br />
