Sunday night dancing. Councilman Armstrong moved, seconded by Councilman <br />Britschgi, that request for permit be denied in accordance with the established <br />♦ 8 <br />policy of the Council not to grant permits for dancing on Sunday nights. Motion <br />passed unanimously. <br />Application was received from John E. Kerber doing business under the name of Kerber <br />Oil Company, 595 El Camino ♦Real, for permit to conduct a used car lot on property <br />situated next to his service station. Councilman Armstrong asked if there wasn"C' <br />an ordinance prohibiting issuing a permit to persons not in the new car business, <br />City Attorney McCarthy said there was no ordinance prohibiting this but that the <br />Y <br />license fee was $250 when issued to a person not a nein car dealer. Councilman <br />Armstrong moved, seconded by Councilman Fletcher, that permit be denied. <br />Councilman Hilton asked on what grounds it was to be denied. Councilman Arm- <br />strong stated he was not in favor of -any additional used car lots on El Camino <br />Real. Councilman Britschgi asked City Attorney McCarthy if the Council could <br />legally deny the permit. City Attorney McCarthy stated that it was within the <br />discretion of the Council to refuse such a permit when it was their opinion that <br />the proposed location was not suitable for the establishment of such a business. <br />Councilman Britschgi asked where the Council was going to allow used car lots <br />if not on El Camino Real. He asked if it would be possible to set up a separate <br />automobile district in the city. He suggested that the maker of the motion <br />amend his motion to refer the application to the industrial committee for further <br />study before it is denied. It was his belief that this committee might be able -to <br />suggest a better location. Councilman Fletcher stated that the Council had just <br />denied Weltner Motor Company a permit for the same reason as was being brought <br />up against this application. Councilman Hilton stated that Weltner Motor Company <br />already had one lot and he felt the Council was discriminating. Councilman <br />Armstrong stated that he would never vote to renew a permit for a used car lot <br />on El Camino Real, stating that the Council was under no obligation to allow <br />these lots to multiply. He believed it was up to the applicant to find another <br />location for his business. Under the question, Councilman McNulty brought up the <br />question about what would happen if the industrial committee recommended they <br />go on the highway and the Council is against their going on the highway. Mayor <br />Granger stated the Committee was merely a study committee and the Council could <br />act as it thought best. Councilman Britschgi stated that his idea was to find a <br />place in town where the used car lots could be grouped rather than having them a1L <br />over town. Councilman Hilton asked when the present used car licenses expired, <br />to which City Attorney McCarthy answered that they expire every June 30th. Motioi <br />passed unanimously.
