City Attorney McCarthy advised the Council that the Southern.. Pacific Company had submitted a lease to the city at $1.00 a year for a portion of the property of the freight yard on the easterly side of Perry Street running 265 feet along Perry Street from Broadway. City Manager Mead explained that this would give the city police power over the parkikig lot. Councilman Armstrong offered adoption of the resolution accepting the lease, seconded by Councilman McNulty. On roll call motion passed unanimoulsy. Councilman Anderson and Fletcher absent K Councilman Britschgi asked if by police power it meant putting a time limit on parking to which City Manager Mead replied that there would be no time limit on the .parking as it was a commuters' parking lot. < City Attorney McCarthy advised the Council that City.•Manager Mead and Street Superintendent Winter had advised him that the Council usually instututed weed abatement proceedings at this time to avoid fire hazard -from dry -weeds. Mayor Granger asked how the weeds were to be disposed of and City Manager Mead said that last year the weeds had been cut and burned and the same procedure' was contemplated this year. Councilman Britschgi asked if a property owner was responsible.for the upkeep of the strip of land between the sidewalk and the curb. City Attorney McCarthy advised Councilman Britschgi that that strip of property is owned by the city but that the property owner is compelled to keep it in good condition. Councilman Hilton offered adoption of resolution covering weed abatement proceedings, seconded by Councilman McNulty. On roll call motion passed unanimoulsy, Councilmen Anderson and Fletcher absent. Mr. Louis Del Ben appeased before the Council in -regard to building on his property which he had been ordered to remove. He was of the opinion that he was 'Within his rights to keep the building there but had been informed by the City Attorney and Building Inspector that the building was in violation of city ordinances. Councilman Armstrong moved that the City Attorney be. instructed to take„proper steps_ to see that, the ordinance was complied with, seconded. by Councilman Hilton. Mr. Del Ben stated the building cost under 050 and did not believe he needed a permit for it, however, he agreed to remove it. Councilman Britschgi asked the maker of the motion to aMend his :motion to read that the matter be placed on the agenda for the next meeting. Councilman Armstrong withdrew h is motion and stated he would,be,willing to accept Mr. Del Bents assurance that the building would be torn down within two weeks. He moved that the matter be placed on the agenda, seconded by Councilman Britachgi. Motion passed unanimoulsy. Clains No. 3833 to 3978 in the amount of $8259.96 were approved and ordered paid on motion of Councilman McNulty, seconded by Councilman Armstrong, Motion passed unanimously. I ` 0 ■
