Councilman Anderson concurred in their opinion and stated that while the city had a•eontraot with the county in regard to health matters,• the city did not, in his opinion, have a contract with the Hassler Health Home or Community Hospital and he believed the fee was in order. Councilman Armstrong asked if any policemen appearing as witnesses were paid a fee to which,City Attorney McCarthy replied they were not inasmuch as they were defendants. Councilman Armstrong was of the opinion that the nurse was acting in the line of duty in testifying and should not be paid.. Vity' Attorney McCarthy did not believe it was in her line -of duty inasmuch as she was not in an administrative position. The claim was allowed. Councilman Anderson requested information in regard to the progress of the -weed abatement and said there was a great number of weeds on Main Street. near Franks Tannery. City Manager Mead reported on the proceedings stating that weed burning had begun and as soon as it was possible the weeds on Main Street would be t burned. City Attorney McCarthy advised the Council that in a recent case the court ruled that cities are acting in a governmental capacity and are not responsible for burning of hedges, etc. during such proceedings. Councilman Armstrong asked, in view of budget time approaching, if it would be possib] to have a financial statement of•the first ten months of the year at the second meeting in May. City Manager Mead stated that provision of the Charter provides for such a statement but that it will be impossible to have it by the next meetir and stated that it will probably be necessary to call a special budget meeting. Councilman McNulty questioned the mayor signing notice of meeting cards of the War Council, believing it should be done by the city manager in view of the action taken at the last council meeting. City Manager Mead stated that the mayor is chairman of the War Council, and Commander of civilian defense and the city manager is Co-ordinator. The motion passed at the last meeting places the administrative duties of civilian defense back into the hands of the city manai but the mayor is the chairman of the War .Council. City Attorney McCarthy advised the Council that the War Council is set up under Ordinance'No.•457 and amended by Ordinance No. 479. The mayor is ex -officio chairman of the Council and the city manager is the administrative head of the Council. Councilman Me; was of the opinion that by declaring the state of emergency .off all matters were put into the hands of the city manager but, in view of the 'foregoing discussion, did not believe much had been accomplished by the action. Claims'No.'4001 to 4046 in the amount of $5,276.93 were,approved and ordered paid on motion of Councilman Armstrong, seconded by Councilman Fletcher. Motion pass unanimously. Councilman Fletcher offered resolution adjourning the meeting out of respect to the. memory of Angelo Garcia who passed away while in the service of his country and instructing the City Clerk to inform his family of the Council's action.
