Cou{incilman Fletcher asked if the county had included this commitment in the tax rate to which Mr. Winchester re- plied that they had gone on record as endorsing that fund and also had given much technical assistance to the committee. City Attorney McCarthy informed the council that the 3/4 of a mill tax levy would amount to 7-:2, cents on $100. Councilman Granger moved that the council concur in the recommendation of the War Memorial Committee, seconded by Councilman Anderson. Under the question, Councilman Britschgi asked if this matter had to be voted on at this meeting, to which City Manager Mead replied that it did not have to be as the tax rate and the final budget would not be adopted until August. Councilman Britschgi stated he would lime to have a meeting with the committee to ascertain just what the plans were as he did not believe the plans now in progress were the ones in mind when the committee was formed. Councilman McNulty concurred in this idea. Councilman Armstrong asked if the levy would affect any other special levy to which City Attorney McCarthy replied that it would not. Councilman Britschgi was of the opinion that, after reading the act, only veterans' organizations could have access to the.building. It was his opinion that the building should be for both civic organizations and veteran organizations. He believed the council and the committee should meet together before any commitment was made. Councilman Granger withdrew his motion with the consent of the second and moved, seconded by Council- man Anderson, that the council meet with the War Memorial Committee Monday, June 26th, at 8:00 P.M. in the Council Chambers. Motion passed unanimously. Councilman Britschgi moved, seconded by Councilman Fletcher, that the recommendation of the Chamber of Commerce be accepted to appoint Joseph Territo to the Citizen's { Traffic Study Committee to replace Al Robertson, resigned. Motion passed unani- mously. tt Communication was read from the California Mission Trails Association asking for an appropriation of $100.00 in this year's budget. Councilman Fletcher moved, seconded by Councilman Armstrong, that the request be denied. Motion passed unanimously. City Attorney McCarthy reported on the matter of the default in contract of H. C. Munson to purchase Lot 51 of Reese Subdivision. This lot comprises a block on the south side of Redwood Avenue. `Four years were allowed to complete the pur- chase. Mr. Munson had paid $625.00 down and the balance of $(;1875 was to be paid in payments of $600 a year for four years from the date of this agreement with interest at the rate of six per cent per annum on all deferred payments. Mr. McCarthy stated that Mr. Munson had kept up his payments reasonably yell through 1940 and 194.1 but had made no payment for more than two years. The balance tide on the contract amounts to $975 plus interest in the amount of $121 to Agpil 30th of this year. Mr. McCarthy wrote to Mr. Munson in regard to the delinquency and stated that it was his duty to enforce the contract. Mr. Munson replied that he did not believe he was obligated to complete the contract. There was some dis-
