Councilman Armstbong asked what the legal rights of the city were in this case and City Attorney McCarthy stated that the city has the legal right to force the contract to be kept or file'a damage suit. Councilman Anderson,moved, sec- onded by Councilman Britschgi that the matter be pl"aced on the agenda and that the council have a statement fro m the city manager as to the status if the con- tract is allowed to lapse and what stand the city can take in case it cannot force the contract, also that the city clerk check on the minutes of the meeting in which this contract was entered into. Motion passed unanimously. Councilman Britschgi moved that inasmuch as the salary ordinance would have to have a provision made for the treasurer's position, that when this meeting is ad- journed it be adjourned to 7:30 P.Pd., Monday, June.26th, for the purpose of adopting the salary ordinance, seconded by Councilman McNulty. Under the questio_'i City Manager Mead asked if it was the wish of the council to have 075.00 included in the salary ordinance for the position of treasurer, stating that the motion read not to�exceed $75.00. He said the amount would have to be stipulated in the ordinance. Councilman Armstrong moved, seconded by Councilman Anderson, that $600 per year, or $50.00 per month, be included in thesalary ordinance'for the position of treasurer. Motion passed unanimously. Councilman Fletcher offered resolution adopting budget and approved memorandum of agreement for expenditure of 1/+cent gas tax allocated for streets of major im- portance, seconded by Councilman Anderson. On roll call, resolution passed unanimously. City Attorney McCarthy advised the council that the City of Atherton and several residents on Middlefield Road were filing a petition with th2 Railroad Comdiission protesting the right of the Greyhound Bus to operate on certain sections of Middlefield Road and the attorney for the City of Atherton had asked the City of Redwood City to sign the petition also. Mr. McCarthy stated that after contactini the councilmen separately, inasmuch as the petition had to be filed before this meeting, he had signed the petition for the City of Redwood City. Councilman I i Armstrong moved, seconded by Councilman Granger, that the council approve the action of the city attorney in filing a petition for rehearing on this matter with the Railroad Commission. Motion passed unanimously. City Attorney McCarthy reported that Leo Basi Orginos had purchased four lots in Block 50, Central Park No. 2,'from the County Tax Collector. The city received $91.12 as pro rata share of taxes. Mr. McCarthy received a letter from Mr. Orginos' attorney who stated that he had been advised by the California Pacific Title Company that it would be necessary to have a quiet title deed or a quit -claim deed from the city. He stated there were no assessments against the property. He recmaended that the council adopt a resolution authorizing the city manager to execute a quit claim deed. Councilman Anderson offered the resolution, seconded by Councilman Fletcher. On roll call, resolution passed unanimously.
