Councilman Armstrong offered resolution adopting the budget as submitted for the fiscal year 1944-45, seconded by Councilman McNulty. On roll call, motion passed unanimously., Councilman Anderson offered introduction of ordinance fixing tax rate, seconded by Councilman McNulty. Motion passed unanimously. Applications for renewal of permit to conduct used car lot were received from Towne Motor Company, Weltner Motor Company, Oleson & Son, Davies Auto Company, Cuddy Motors and Dearborn Motor Sales. Councilman.Fletcher moved, seconded by Councilman McNulty, that permits be granted. Under the question, Councilman Armstrong said he was against used car lots on E1 Camino Real and•a:sked City Attorney McCarthy if permits for same were transferable. City Attorney McCarthy replied they .were not transferable from one location to another and, after referring to the ordinance, stated they were not assignable or saleable. Councilman Armstrong stated he was willing to protect the present owner but that he would never vote to allow used car lots on El Camino Real and asked the maker of the motion to amend his motion to include that these permits are not transferable, stating that if one of the businesses were sold, the Council could deny a permit to the new owner. Councilman Fletcher was of the opinion that that would be practically a confiscation of property. The amendment was not made to the motion. Motion passed unanimously. Councilman Armstrong moved to place on the agenda a discussion of the policy of the Council regarding used car lots on El Camino Real at the expiration of these licenses, seconded by Councilman Granger. Councilman Britschgi believed it was a matter to be referred to the Industrial. Committee, while Councilman -Armstrong believed it was more a matter for the Planning Commission. He so amended his motion. Motion passed unanimously. Councilman McNulty offered resolution and moved its adoption authorizing the City Manager and City Clerk to sign agreement with the Southern. Pacific Company for water pipe line to be placed under spur track, seconded by Councilman Fletcher. On roll call, motion passed unanimously. ,
