Councilman Armstrong moved, seconded by Councilman Fletcher, that notice of publica- tion of ordinance fixing tax rate be filed. Motion passed unanimously. Councilman McNulty moved adoption of ordinance fixing tax rate, seconded by Council- man Granger. On roll call, motion passed unanimously. Councilman -Anderson moved adoption of ordinance regarding proposed bond issue, sec- onded by Councilman McNulty. It was not necessary to publish this ordinance. ". On roll call, motion passed unanimously. City Clerk Dodge read legal ruling, from Mr. McCarthy in retard to sale of library building at Broadway and Jefferson, in which it was stated that the deed to this building was cogveyed by the Sequoia Union High School District to the City of Redwood City and is now free from any restrictions and the city is in a position to convey a title free and clear of all encumbrances and all restrictions whenever a sale of said property is made. City Clerk Dodge also read the legal procedure to be followed if a sale of the property is made. It is necessary to decide whether the building will be sold at public auction or whether sealed bids would be called for and also an appraiser must be appointed. If sealed bids are=:called for, the appraisal: must,, be in before the sealed bids are opened. Mr. Ludwig Werder stated that he had a party interested in the Whole block Who would not be interested in one piece unless he could buy the other. He stated he was interested in'knowing what procedure was going to be 'followed . City Clerk read resolution authorizing the sale of old library building and calling for sealed bids. Councilman Armstrong offered resolution, seconded by Councilman Fletcher.- On roll call, motion passed unanimously. There was some other discussion in regard to whether the money'from the sale would go into the general fund or not. Councilman Armstrong was of the opinion it should 'so to the general fund and then be appropriated into anoth=r fund. City Manager believed it would be wise to appropriate the money into the postwar fund and specifically earmark it. There was some discussion in regard to the appointment of an appraiser. Mr. Graham Adams stated the American Trust Company had�an appraiser who was employed directly by the bank and who would probably charge the city a fee. Mr. Ludwig Werder advised the Council that Mr. Laurence Heiner was the only qualified appraiser in Redwood pity outside of the bank appraisers and said the customary fee is $50.00. Councilman Granger offered the name. of Lawrence Heiner as appraiser, sec- onded by Councilman Anderson. Under the question, Councilman Britschgi was of the opinion that the fee should be settled before appointing an appraiser. Councilman Anderson suggested that the maker of the motion amend his motion sub- ject to the fee being approved by the City Manager. Councilman so amended his motion. Motion passed unanimously. City Attorney McCarthy reporteO, that he had done considerable work nn the matter of assessing the telephone company but said that his report was not complete and asked to have the matter placed on the agenda for the first meeting in October. Council- man Granger moved the matter be carried on the agenda for the first meeting in October, seconded by Councilman McNulty. Notion passed unanimously. 0
