1 N I City Attorney licCarthy reported that he had attended the hearing before the Board of Equalization in regard to the issuance of a liquor license to the Two Friends Cafe. He also advised.that Chief Collins also attended. He said Thornton Walker was represented by counsel and that Ur. Walker had been fingerprinted. There was no record of any charge against him. ILo. McCarthy advised that he had reported that the Council was against the issuance of a permit for the reasons that there had been several instances of disturbances of the peace in the past f ew years and because it believed there were enough drinking places on El Camino Real. He said in opposition,to these views, the fact was brought out that the neighb�-rhood in which this place'of business was located was largely Negro and Mexican and it was thought they should 1iave a place to meet, Mr. McCarthy was advised by the Board that it could not deny the application merely because of the view of the council that there were enough such places on El Camino Real. It could only,deny it on the unfitness of the character of the applicant. No deci- sion was made at the present time but one will be rendered in a short time. City Attorney McCarthy explained that Mr. A. E. Alldis had presented a plan and map of subdivision on Valota Road to the Planning Commission who had approved the subdivision being divided into fourteen lots.with a street down the middle pro- viding for a turning area of sufficient size. The Planning Commission required that a sewer be put in the middle of the road provided by the owners of the prop- ertyeo that it would carry into the Kentfield area. Mr. McCarthy stated he .had prepared a contract between the subdivider and the city whereby they agree to make all the improvements therein specified; sewerEj, pavement of street the full width, install curbs and gutters and sidewalks, water line and street sign and street markers at the end. The resolution which the Planning Commission adopted had been fully complied with. The street work has not been done and, therefore, under the ordinance, a bond must be furnished. The Engineering Department esti- mated that a $12,000 bond would cover the w%rk. He advised the council that Mr. Alldis has a bond signed by the principals but not by the surety company. He wished the council to approve the map subject to the bond being furnished in the amount of $12,000. There was considerable discussion ;bn regard to the location of the property and whether or not commercial enterprises would spring up. Pair. Ludwig herder ob- jected to the subdivision on the grounds that his company was developing a resi- dential district nearby and he believed there would be considerable chicken raisir:g in this new subdivision. Councilman Fletcher moved adoption of the resolution approving the subdivi- sioll subject to the bond being furnished, owing, to the fact that the Planning Commission had approved the map, seconded by Councilman Granger. Under the ques tion, Councilman Granger asked if the map were to be recorded. City Attorney McCarthy replied that it would be but that neither the map nor the resolutidn would be recorded until the bond,is furnished. Councilman Granger suggested that:: the motion include that the map be approved and not cprtified until. the bond is posted. On roll call, motion passed unanimously.
