Communication was received from the State Board of Equalization of ref ereeIs'findings and recommendations after hearing in :,egard to the matter of the protest of the City Council against the issuance of an on sale beer license t6 Thornton Walker, dba Two Friends Cafe. The recommendation was that - the application be denied for the reason that the &p -p 18: 81 :3=a41 '3? t.a; ? .sof: th,: t it ;, premises pro- bably would become a police problem. There was also a communication from George Id. Stout, State Liquor Administrator, which advised that this recommendation was not a final decision'by the"Board and that the Board would render a final de- cision at a later date. Communication was ordered filed. Communication was received from the League of California Cities advising that a one day conference was to be held in San Francisco on October 10th at the Fairmont Hotel from 10:00 A.Dl. to 9:00 P.M. City Attorney McCarthy entered the meeting. The Clerk noted those signifying their intention of attending the conference. Application was received from Midway Creamery operated by V1. E. Mansfield for a trans- fer of restaurant license. The creamery was former operated by Pearl and Elmer Gange. License fee of $15.00 for balance of the year has been paid. Councila- man Fletcher moved, seconded by Councilman Anderson, that permit be granted. Councilman Armstrong, under the question, asked. if the. restaurant had been in- spected by the health department, to which Inspector Stein replied that it had not been for the past two months. Councilman Fletcher amended his motion to in- clude subject to the approval of the health deL)artment. Motion passed uanimouslT. Application was received from Lars 0. Anderson and Leonard Id. Hansen for restaurant license at 768 Woodside Road. The Clerk advised the Council that at the last meet- ing the Council had voted to protest the issuance of a liquor license to F. Mon- isteri at this same address. In. the application for a restaurant license, the applicants state they have liquor for on sale spirits, P -7613-E, on sale beer and wine, A -11587-E. The Clerk stated he had i:a°itten to the Board of Equaliz- ation advising the Council wished to protest the issuance of a liquor license to Mr. Monisteri at this address and that he had received a reply on September 28th advising that the Council hrd no grounds to oppose the issuance of the license and that if the Council wished to file a new protest it was necessary to file it not later than September 27th. The letter was received too late to file a new protest. Attorney James O'Keefe, Jr. appeared before the Council in behalf of Mr. Anderson and Mr. Hansen, stating that the zone in which the restaurant would be located permits restaurants, that the persons rano are to operate the business are fit and proper persons and the health department gave a gr=ade of 94.5, an A ratin37 after inspecting the premises. He stated he believed the license for a restaurant was denied at a previous meeting because of the number,of protec- tants who, he believed, thought it wotild be e revival of an establishment run by Cal Bunyard. He presented affidavits signed by Philip A. Bunyard oxia Una L. Bunyard stating that they are owners of the property upon vFnich the restaurpnt is located, that they have entered into a lease agreement with Mr. Anderson and Mr. Hansen, that there is no relationship betr:een them , that their son, Ce. Bunyard, hfs no right, title or interest in the premises and that their only interest in the matter is to secure performance of the lease. Pair.
