There was some discussion in regard to a used car lot ordinance which was to be presented to the Council for consideration, and whether or not this ordinance would have any bearing on a permit issued to Mr. Van Buren. Mr. Scott explained that Mr. Van Buren had, met with the Planning Commission and had suggestec c er- tain provisions be included in the. ordinance. He said that Mr. Van Buren was agreeable to be bound by all provisions. of the ordinance if it were adopted. city Attorney McCarthy advised the Council in reply to a question asked by Councilman Fletcher that Mr. Van Buren, if granted the permit, would be bound by the terms of the ordinance if it were adopted. Councilman Fletcher moved that the permit be granted, seconded.by...Coungilman Anderson. Under the question, Councilman Armstrong ask8d if the permit were being granted for the location There Mr. Van Buren is now doing business and was advised that it was, the location being 332 E1 Camino Real. Councilman Britschgi said he was going to vote in favor of the motion although he was not in, favor of too many used Car lots being located on E1 Camino Real. Motion passed with Councilman Armstrong• voting in the negative. Councilman Armstrong stated that two matters had been submitted to the Tax Committee several weeks ago and that at the previous meeting a report had been made in re- gard to increasing the license tax paid by theatres. He explained that an ordi- nance fixing the license fee paid by theatres he,d been introduced at the previous meeting and was up for adoption at this meeting. The other matter concerned a franchise or license tax being imposed on utilities which are not now paying a license ,tax to the city, one of such utilitfs being the Pacific Telephone and Telegraph Company. He stated meetings have been held with the City Attorney and representatives of the telephone company and that the City Attorney had advised that it would be impossible to impose a franchise or license tax on these utilities at other than the rates for merchants in general. He further advised that the Pacific Telephone and Telegraph Company, as well as other utilities. -have heretofore paid no license tax whatever and that legally these utilities are liable to pay a tax for the past four year period not barred by the Statutes of Limitation. Councilman Armstrong;., the,reftlre, moved that the proper officials be instructed to direct a letter to the Pacific Telephone and Telegraph Company, Pacific Gas and Electric Company, libstern Union Company and Southern Pacific_ Company asking for an estimate of their gross receipts for the past four year period beginning July 1, 1940, and ending: June 30, 1944, the mo- tive being that after receipt of such information, or failing to secure such in- formation, d. demand may be made upon these utilities for the tax not paid for this past four year.period, seconded by Councilman Fletcher. City Attorney Mc- Carthy advised that it should be spedified in the motion that the estimate for gross revenue should be for those revenues collected within .the City of Redwood City. Councilman Armstrong accepted the amendment to the motion. Motion passed unanimously. Mr. Thomas Giannini appeared protesting the resubdivision of Lot 21, Block 18, Central Park. ,He stated that he had.rpceived a telephone call from Mrs. Josephine C. Offerman who owns the adjoining'.lot and who said she has plans for building after the :Tar. If the subdivision is allowed, the back yard of the resubdivided lots would face her dining room window.
