Motion passed unanimously. <br />Planning. Commission recommendation No. 7�-. Favorably recommended that F. C. <br />Duffy be granted permission to locate a,soft drinks bottling works on Lot 12, <br />B};ook 27 of Eastern Addition, southerly corner of Spruce and Shasta Streets. <br />Mr. Duffy appeared in behalf of his request and advised that the property <br />appeared to be in the commercial district and that his business would not <br />constitute a muisanee. Councilman Britsehgi moved, seconded by Councilman <br />Fletcher, that the recommendation oi the Planning Commission be.aeoepted. <br />Motion passed unanimously. <br />Mr. W. H. Morrisse attorney, appeared in behalf of H H Weiner i <br />Y, Y, PP n regard to <br />his request for cancellation of delinquencies on lots in the Lenolt Tract, <br />Mr. Morrissey advised that in 1940 the West Coast Life was instituting fore- <br />closure proceedings against thi's.propert'y which was unimproved. Mr. Weiner <br />paid the interest due the West Coast Life and the Council entered into an <br />agreement with him that if he bought 102 lots in this tract and got them <br />bask on to the assessment roll, the Council would accept one half of all <br />penalties and all the taxes. Mr..Motriesey stated that the present request <br />was in conformity with this agreement: City Attorney McCarthy read a letter <br />from City Collector Miramontes which had been presented at an earlier meet- <br />ing setting forth the offer made.by Mr. Weiner as follows: Lot 8, Block 10, <br />Lenolt, total delinquencies $1253 - Mr. Weiner offered #700. Lot 8, (took 7, <br />Lenolt, total delinquencies, $728.85 - Mr. Weiner's offer, $515.« Lot 2, <br />k <br />Block 10, Lenolt, total delinquencies, $733.59 - Mr. Weiner's offer, $525. <br />Councilman Armstrong believed•it was highly improper for the council to <br />Kj <br />I <br />E <br />compromise the indebtedness of a property.owner to the city on the basis of <br />an offer. He believed the proper method would be to have the lots put up <br />for public sale and bid for. Mr. Morrissey stated that when the orignal <br />agreement was made it was felt that the city would get a better offer than <br />the lots would bring in a public sale. Councilman Anderson said he con- <br />curred in Councilman Armstrong's opinion bu that at the time the agreement <br />was made it was felt the terms of the agreement were the best the city <br />could do and that inasmuch as'there remained only three lots to be redeemed, <br />he did not believe a change should be made at this time. Councilman <br />Anderson.moved that the city accept payment of taxes against the above men- <br />tioned lots in full and one-half of the penalties. The motion was seconded <br />by Councilman Fletcher. Under the question, Councilman Armstrong asked <br />what was to be done with the sewer bonds which Mr.' Weiner holds. Mr... <br />Weiner advised he would surrender the sewer bonds. City Manager Blom advised <br />that the County Tax Collector had included one of the lots in qu4stion in <br />nine parcels for sale for delinquent taxes. Mr. Weiner advised he had <br />paid the county taxes and that ,the -lot would not go on sale. Motion passed <br />with Councilman Armatrong voting in the negative. <br />City Clerk Dodge reported that he had sent out post card notices to property <br />owners on Beech Street in regard to improvements on that street.
