Motion passed unanimously. <br />'j City Attorney McCarthy advised that there are several pieces of property which the <br />�. appraiser, Mr. Heiner, is ready to purchase in regard to the recreation area, <br />i <br />and asked if tpe Council desired to have the deeds filed with the City Clerk <br />f <br />or with the title Companies. Councilman Armstrong believed it would be ad- <br />visable to have the title companies handle the complete transaction and <br />1i moved that the City Attorney be instructed to close deals relating to the con <br />demnation suit for the recreation area through the title companies in the <br />[ <br />regular way, seconded by Councilman Werder. Motion <br />passed unanimously. <br />Councilman Armstrong moved, seconded by Councilman Brits' hgi, filing of affidavit <br />of mailing and posting of notices of hearing on proposed improvements on <br />`{ Sapphire, Taft, Ruby Streets, etc, Motion passed unanimously. <br />There were no protests and Councilman Armstrong offered resolution and <br />moved its adoption of resolution of preliminary determination to make improve <br />j) ments on Sapphire, Taft, Ruby Streets, etc. The motion was seconded by' <br />j Councilman Granger and on roll call resolution was unanimously adopted. <br />z ' <br />'. <br />R E S 0 L U T ION No. 328 <br />4' DETERMINING TO MAKE IMPROVEMENTS WITHOUT COMPLIANCE WITH INVESTIGATION ACT. <br />RESOLVED, by the Council of the City of Redwood City, California, that <br />i <br />WHEREAS, on the 6th day of May, 1946, this Council adopted Resolution <br />No. 313 entitled "Resolution of Preliminary Determination to Make Public <br />j Improvements in Sapphire, Taft and Ruby Streets" to construct certain pub - <br />lie improvements more particularly therein described and did fix Monday <br />�- the 20th day of May, 1946 at 8 o'clock p.m, at the Council Chambers in the <br />City Hall in said City as the time and place when and where any and all <br />persons interested may appear and show cause, if any they have, why the City <br />Council should not find and determine that the public convenience and neo- <br />essity require the improvements described and referred to in said Resolution <br />without compliance with the Special Assessment Investigation, Limitation and <br />Majority Protest Act of 1931; and <br />WHEREAS, notice of the adoption of said Resolution of Preliminary De- <br />termination and of said time and place of hearing was given by the City <br />Clerk by publication and posting for the time and in the manner provided in <br />said Resolution and in Ordinance No. 515 of said City, as appears from <br />affidavits on file with the City Clerk; and <br />Or WHEREAS, no written objection to the undertaking of said proceedings <br />without first complying with the provisions of said Investigation Act has <br />been filed with the City Clerk at or before the time fixed for this hearing <br />by persons interested, owning or having an interest in real property within <br />the assessment district, bearing their signatures, a description of their <br />property, and a statement of the nature of this interest therein; and <br />WHEREAS, all persons interested have been given an opportunity to be <br />and were fully heard, and said Council has duly considered any and all ob- <br />jections improvements, and the public convenience and necessity for making <br />same. <br />NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: <br />1. That the public convenience and necessity require the improvements <br />described in said Resolution of Preliminary Determination. <br />2. That any and all objections and protests made pursuant to said <br />�I Resolution of Preliminary Determination be and the same are hereby over- <br />ruled and denied. <br />3. That the improvements described in said Resolution be made under <br />and pursuant to the provisions of the Redwood City Ordinance No. 333, and <br />that the Special Assessment Investigation, Limitation and Majority Protest <br />Act of 1931 shall not apply to said proceedings. <br />I hereby certify the foregoing to be a true copy of Resolution No. 328 <br />adopted by the City Council of the City of Redwood City, Cal4fornia, at a <br />regular meeting thereof held on the 20th day of May, 1946, by the following <br />vo a of the members thereof: <br />
