There was some discussion in - <br />regard to the wording of the motion and Councilman Armstrong reworded his <br />t motion as follows, seconded by Councilman Britschgi, offered for adoption <br />Pv <br />resolution authorizing the City Attorney to institute the necessary condem- <br />o-r� f <br />{j nation proceedings in regard to the property outlined by the City Manager. <br />On roll call, resolution was unanimously adopted. <br />s RES 0 LUT I ON No. 334 <br />{ AUTHORIZING CONDEMNATION OF LANDS IN FEE FOR SEWAGE. -..TREATMENT AND DIS- <br />POSAL PLANT AND ANIMAL SHELTER <br />RESOLVED, by the City Council of the City of Redwood City that it <br />finds and determines and hereby declares: <br />That public interest and necessity require the acquisition, construc- <br />tion, and completion by the City of Redwood City of a public improvement, <br />namely, a sewage treatment and disposal plant and animal shelter in that <br />certain property hereinafter in this resolution described; <br />That the use of all of said land for said sewage treatment and disposal <br />plant and animal shelter are planned and located in a manner which will be <br />j. most compatible with the greatest public good and the least private injury; <br />FURTHER RESOLVED that the City Manager of this City be and he is here- <br />by authorized and empowered: <br />To acquire in fee, in the name of this City, the real property herein- <br />after described, by condemnation, in accordance with the provisions of the <br />Code of Civil Procedure of the State of California relating to eminent <br />domain; <br />To prepare and prosecute, in the name of this City, such suit in the <br />proper Court having jurisdiction therein as is necessary to condemn such <br />i lands in fee for such use; <br />To make application to said Court for an order fixing the amount of <br />such security in the way of money deposits as said Court may direct to be <br />made upon the taking of possession of said property by this city, and for <br />an order permitting this City to take immediate possession and use of said <br />I� ! property; <br />To make deposit of such security out of proper funds of said City in <br />such amount so fixed and determined and in such manner as said Court in <br />which the condemnation proceeding hereby authorized is pending may direct. <br />The real property hereinabove referred to is situated in the City of <br />Redwood City, County of San Mateo, State of California and particularly <br />described as follows: <br />PARCEL 1 <br />BEGINNING at the most easterly corner of Steinberger Street as <br />shown on the official Map of Redwood City as prepared by C. L. <br />Dimmitt, City Engineer, in 1940; running thence along the southeast- <br />erly right-of-way line of the said Steinberger Street, south 33039, <br />west 150 feet, south 550241 west 300 feet, and south 330391 west 700 <br />feet; thence south 560211 east 420 feet; thence north 330391 east <br />1090 feet, more or less, to the center of Steinberger Creek, thence <br />j down the center of Steinberger Creek to the point of beginning; being <br />an area of 10.01 acres, more or less. <br />PARCEL 2. <br />BEGINNING at a point on the northwesterly right-of-way line of <br />Steinberger Street as shown on the official Map of Redwood City as <br />prepared by C. L. Dinnitt, City Engineer, in 1940, said point of begin- <br />ning being distant south 330391 west 130 feet along said northwesterly <br />right-of-way line from the most northerly corner of said Steinberger <br />Street; and running thence from said point of beginning along said <br />northwesterly right-of-way line, south 330391 west 1068.15 feet; thence <br />north 27030' west 447.75 feet to a point on the southerly bank of Red- <br />wood Creek, as shown on the aforesaid Map; thence along said southerly <br />bank, north 62030' east 398.86 feet; north 49030' east 265 feet, north <br />550561 east 273 feet, and south 450oo' east 24.30 feet to the point of <br />beginning, being an area of 4.74 acres,,more or less. <br />FURTHER RESOLVED that the City Manager be and he is hereby authorized <br />to prosecute a suit in eminent domain to acquire for said City an easement <br />ten feet in width parallel with the northerly line of Bayshore Highway and <br />distant 153 feet northerly of the present center line thereof from the <br />easterly line of Steinberger Street to the westerly line of Harbor Boulevard <br />for said sewage treatment and disposal plant with the right to maintain a <br />sewer pipe or pipes therein and ingress to and egress from said right-of- <br />way for the construction, repair and maintenance of such pipe or pipes. <br />3615 <br />
