46 <br />Anderson, Granger and McNulty. Noes and against the motion: Council- <br />men Armstrong, Britschgi and Mayor Hilton. Absent: Councilman Fletcher. <br />Councilman Anderson moved the abatement proceedings against Mr. <br />Klang's property be continued to the first meeting in August and Mr. <br />Klang be notified to appear before the Council to show cause why the <br />abatement proceedings should not be continued. The motion was seconded <br />by Councilman Britschgi and passed unanimously. <br />City Manager Mead advised that Fire Chief Ryan, Building Inspector Duncan, <br />and Health Inspector Stein had made an inspection of the property known <br />as the Old Harder Ranch and had recommended abatement proceedings be <br />instituted. City Attorney McCarthy advised that notices had been mailed <br />to the owners and that the property had been posted. <br />Attorney Louis Dematteis aTpeared before the Council in behalf of <br />one of the owners of the property, a Mr. Rostani, and advised that he <br />had purchased the property only a few months ago entirely unaviare that <br />there J3ad been any discussion in regard to this property. He said that <br />since he had purchased the property the chicken business has been dis- <br />continued, that a fence had been taken down and also a number of sheds <br />removed. Mr. Dematteis was of the opinion that the buildins were not <br />delapidated and that the chicken sheds have substantial concrete flooring. <br />He said that while the buildings were not the best kept neither were they <br />in the worst condition in town and the mere fact that they were unsightly <br />would not be a basis of abatement unless there was something else that <br />makes then offensive. In regard to the evidence of rats as reported in <br />the inspectors' recommendation, Mr. Rostani had informed him that he had <br />seen no rats since he purchased the property. He said there was no feed <br />on the property but that Mr. Rostani would be willing to place rat eradi- <br />cator around. In regard to the room in the bar which was reported to be <br />used for living purposes, he advised that the barn is now used as a garage <br />and the room is not used for living purposes. At the time of the inspec- <br />tion it was reported that the premises appeared unoccupied. Mr. Dematteis <br />said in view of the foregoing that he did not believe there was any basis <br />for condemanation and asked that the matter be continued for the duration <br />in its present state so that Mr. Rostani would not be nut to the expense <br />of taking the buildings down at this time. He did sPy that he would be. <br />willing to whitewash the buildsings if the Council so desired. Council- <br />man Britschgi brought out the fact that he did not believe that the objec4.` <br />tion was so much to the buildings as to a fence along the property which <br />was falling dorm. It was brought out that this fence was not on Mr. <br />Rostani ' s property alone ,but on all the property on that street.
