He believed <br />the other matters were up to the fire and health departments. "Mr. Dematteis <br />asked if the matter could not be put over without having testimony taken. <br />City Attorney McCarthy said he would like to have the testimony taken while <br />the owners and the attorney were present and then the Council could take what <br />i disposition it wished in the matter. <br />Fire Chief Ryan, Building Inspector Duncan and Health Inspector Stein <br />were sworn in and the following testimony taken: <br />City Attorney McCarthy: Do you concur in this report which was dated June 1, <br />and which the Clerk has read here. What is the section, Chief? <br />a Chief Ryan: I dont know. Chapter 1, I think:. <br />n <br />City Attorney McCarthy: What is the character of the section you have in mind? <br />Chief Ryan: I don't know. If I knew holy to say it, I wouldn't ask'you to read it. <br />City_Attorney McCarthy: All right. Is there anything else then that you care <br />to say, Chief? <br />Chief Ryan: No. <br />City Attorney McCarthy: Do you know, Mr. Duncan, who took the photographs! <br />Building Inspector Duncan: No. <br />Health Inspector Stein: A memo er of the department took them. <br />City Attorney McCarthy: Were you there when they were taken? <br />Health Inspector Stein: I was. <br />City Attorney McCarthy: I would like to offer the photographs to substantiate . <br />the proceedings. (There were four photographs showing the physical outlay <br />of the property and properly titled.) <br />City Attorney McCarthy: Mr. Stein, may I ask you in your part of this report, <br />were you present with Mr. Ryan and Mr. Duncan when this inspection was <br />made on June 1? <br />Health Inspector Stein: I was. <br />City Attorney McCarthy: The part of the report that pertains to the health de- <br />partment is: 'One room in barn, formerly used for living, has wash basin <br />drain to ground.11 <br />Health Inspector Stein: That's right. <br />City Attorney McC4rthy: "Barn situated at property line and 40 feet from new <br />houses in new subdivision. S foot high board fence in badly delapidated <br />condition. Some rats still infest barn but most have gone into neighborhood <br />seeking food." <br />
