Health Inspector Stein: That's right. ,
I
City Attorney McCarthy: Are those statements of the conditions true?
Health Inspector Stein: They are true. The chicken sheds themselves
are in fairly good structural condition. The barn structure is
becoming delapidated because of it being infested with rats.
City Attprney.McCarthy.: Is there any foundation under the barn?
Health Inspector Stein: I believe it is wood.
City Attorney McCarthy: The photographs show that the foundation is
rotted away.
Health Inspector Stein: In some instances, yes.
City Attorney McCarthy read Section 1 of Ordinance No. 303.
Chief Ryan: That is a very good description of the property and the
fire department takes the stand that the property should be abated.
City Attorney McCarthy:to Building Inspector Duncan: There is nothing
you could add to that except.that the appearance is delapidated?
Building Inspector Duncan: That is right.
City Attorney McCarthy asked that the affidavits of posting of notices
and mailing of notices on June 1$ be,filed with the City Clerk.
Councilman Anderson: Mr. Duncan, you say that the bar was also struc-
turally sound?
Building Inspector Duncan: It is a little delapidated but the barnis
as sound as the chicken house.
Mr. Dematteis: The sheds are structurally sound and there is a solid
concrete foundation. ,When you were there I assume and I under-
stand that there was probably some chicken wire. That Lias re-
moved, was it not, when you were there?
Building Inspector Duncan:' Yes.
Mr. Dematteis: Now the 'garn, as you have stated, is fairly sound too,
is it not? So that there could be no objection from the structural
part of those?
Building Inspector Duncan: No.
Mr. Dematteis: Did you see any rats when you were there?
Health Inspector Stein: We saw the trails. We saw no rats.
Mr. Dematteis: They could be from months ago.
Health Inspector Stein: I saw in the course of the inspection the slimy
path the rat makes in going over the ground - oil-- didn't see any
rats.
Mr. Dematteis: That the health standpoint - the rats -and the room, is it not?
Health Inspector Stein: Yes.
Mr. Dematteis: Mr. Ryan, as far as the fire hazard, what is there about
the property that makes it a fire hazard?
Chief Ryan: The place is open, anyone can enter it. I contend that any
building that is not used and ppen to the public is a fire hazard.
' Mr. Dematteis: Do you mean that any building open to the public could
constitute a fire hazard? If the building is now occupied by a
family it would overcome the principal part of your objection,
wouldn't it?
Chief Ryan: What -you are talking about is the residence. The most im-
portant part is the chicken house.
Mr. Dematteis: But it is adjacent to the house. If there are occupants
in the house they would have access to it. Your objection and the
' position you take is that it isn't properly supervised.
0
I
