I don't know whether I should form an opinion.
Those people are in a business and are raising flowers. 'Doubt if that
property would ever be used.
Mr. Dematteis: Maybe my garage is more susceptible to catching fire.
Chief Ryan: That is right but no one has raised any question about yours.
Mr. Dematteis: I think the thing presents itself quite strongly. The buildings
are structurally sound. There is some evidence of rats --they are gone
now and Mr. Rostani says he has seen none. As far as the fire hazard,
if these places were not abated and no one there, transients could find
shelter and I can see that it might cause a hazard. I can hsftre you that
the premises are occupied. The area around the sheds and garage is being
cultivated. It is supervised as good as any place in town. I don't be-
lieve there is anything to abate from the testimony given by the city
officials.
City Attorney McCarthy advised there was a resolution which should be adopted
and which some minor changes should be made in line with the evidence given,
such as ; the barn is delapidated and probably a nuisance and a fire meance and
the chicken sheds are in a delaptdated condition. He -asked Mr. Stein if he
would approve the chicken sheds for chickens. Mr. Stein advised that about four
years ago it was decided that these sheds would never be used for chickens again
inasmuch as there were several complaints from the neighbors.
Councilman Anderson moved the matter be continued to the first meeting in
August along with other abatement matters, seconded by Councilman McNulty. Mo-
tion passed with Councilman Britechgi in the negative.
Mr. Dematteis asked if this would be continued automatically without any
action,'being taken. Mayor Hilton did not believe this was in the same category
as the other abatement proceedings. Mr. Dematteis said the fire hazard might
have been there when the inspection was made but he believed the conditions have
changed. City Attorney McCarthy stated that he did not believe the fire chief
had recinded his opinion that there is a fire hazard. Councilman Granger asked
if the barn were the greatest complaint. Fire Chief Ryan replied that he was more
interested in seeing the chicken sheds removed and he believed the bar could be
improved. City Attorney McCarthy asked if they were a menace because they are
within a reasonably close distance to the adjoining homes and fences. Chief Ryan
agreed with that and also said they were a menace because they were so far from
the house in which people are living. Councilman Anderson explained that by his,
motion he meant the matter to continue from month to month with no action being
taken. He withdrew his motion and Councilman McNulty withdrew his second. Council-
man Anderson moved the matter be dropped. Councilman Armstrong asked if the fence
should not be removed. It was the opinion of both Councilmen Anderson and Brits-
chgi that the fence was not entirely on this property and therefore not the respon-
sibility of Mr. Rostani. There was no second to Councilman Anderson's motion and
he moved that the present abatement proceedings be dropped and the City Attorney
be instructed to take the necessary steps to abate the fence.• Councilman Granger
was of the opinion that the recommendations of the heads of the departments should
be followed, while Oouncilman Armstrong was of the opinion that according to the
testimony
given the hazards as listed in the
report had been removed.
There was
no second
to Councilman Anderson's motion.
Councilman Granger moved
the matter
TL"]
be placed on the agenda for the next meeting with the idea of the Council inspecting
