66 <br />M <br />asked that a report be had at the next meeting as to whether this matter <br />V®d . <br />had been approved by the Council.' <br />Councilman Granger asked about the sale of guns in excess of O.P..A. prices. _ <br />City Manager' Mead advised that the guns were sold in accordance with <br />the terms'of the'Charter and that no question had been raised until <br />after the guns were sold as to whether the O.P.A. applied to the City. <br />He said that hbehad taken the stand thatinasmuch as the War Manpower <br />Commission and the Little Steel Formula did not apply to the'city that <br />the O.P.A. did not and that the City Attorney had concurred in this <br />opinion. He said there had been decisions made in other cities that <br />the O.P.A. did not have jurisdiction over the city. Councilman Arm- <br />strong asked who made the compldintg. City Manager Mead replied that <br />there had been no complaint made by anyone, neithertthetbuyers of the <br />guns nor the O.P.A. City Attorney McCarthy advised that the city <br />manager has to comply with the terms of the Charter and the O.P.A. <br />ruling does not come within the terms of the Charter. <br />Councilman Britschgi asked if the city could pass an ordinance providing <br />for rat proofing of houses. City Attorney McCarthy advised that the <br />City of San Francisco has an ordinance which provides that no house <br />shall be constructed unless it has a concrete flooring which will pre- <br />vent rats getting through. Building Inspector Duncan advised it <br />�i <br />called for two inches of concrete. Councilman Britschgi asked that <br />the matter be placed on the agenda for a report at the next meeting. <br />Councilman Granger stated that about two years ago the council had tem- <br />porarily waived the requirements for the size of vents and moved that <br />the temporary permission be rescinded and that 410 vents be required <br />Councilman Armstrong s aid 's everal requirements of the building code <br />were waived at that time and he would like to see the motion include <br />that any relaxation of the building cede be rescinded and from hence- <br />forth the code be enforced. Councilman Granger accepted the amend- <br />ment to his motion which was seconded by Councilman Armstrong. The <br />motion passed unanimously. <br />Councilman Britschgi asked if there could be something done to make people <br />adhere to the setback lines as practiced in the neighborhood, citing <br />an example of a house recently built on Edgewood Road which does not <br />conform to the setback of the other houses on the s treet�. City Attor- <br />ney McCarthy expressed the opinion that if the Building Inspector re- <br />ceived an application to build which did conform to the setback lines <br />but did not conform to the setback as observed by the adjoining or <br />neighboring homes that he might hold up the permit until it had been <br />
