I �w <br />(_ of the first fire district, however, he stated that the Council had not granted <br />X69 <br />G a variance at this location but did, by resolution, agree to grant a variance if <br />plans were presented which met the approval of the Council within a <br />period of one <br />year from June 17, 194.6. He stated that before any variance can be granted an amend- <br />ment to the zoning ordinance must be passed to make such a variance legal. He pre- <br />sented an excerpt from the minutes of June 17, 194, stating Council action at that <br />' time. Councilman Werder saw no objection to granting a variance for business at this <br />location. He did believe there should be some change in the plans as presented so <br />that the,parking lot and truck entrance would not be on the residential side of the <br />property. City Attorney Currie, upon being asked for his opinion, advised that it <br />' is illegal for the Council to grant a variance. He stated the property could be <br />rezoned but by doing that the Council would lose control over the type,of building <br />which could be erected. The Planning Commission is working on an ordinance at the <br />present time which will permit variances, however, to grant the variance if the plans <br />are approved by reason of its action on June 17, 1946. Councilman Werder moved, <br />seconded by Councilman Britschgi, that the matter be laid over until the next meeting <br />i. <br />to allow both the Planning Commission and City Attorney time to study the matter <br />further. Motion passed unanimously. <br />COMMUNICATION WAS RECEIVED FROM CITY MANAGER BLOM SUBMITTING SPECIFICATIONS for various <br />r <br />positions in the personnel system. The Board of Review had approved these specifi- <br />cations at their last meeting at which both Councilmen Granger and McNulty were <br />present. The specifications presented were for the positions of City Collector, <br />Street Foreman, Parking Meter Service Man, Watchman - Port, Deputy Assessor, Park and <br />Building Superintendent and Assistant Recreation Director. The last two were revis- <br />ions of specifications now in the system. The majority of the Council were reluctant <br />to approve the specifications without an opportunity to study them further, however, <br />Councilman Werder believed the City Manager's recommendation and approval by the <br />Board of Review was sufficient. He moved, seconded by Councilman Britschgi,.that <br />the specifications as presented by the City Manager be.approved. A roll call vote <br />was requested and the following vote recorded: Ayes and in favor of the motion: <br />Councilmen Britschgi and Werder. Noes and against the motion: Councilmen: McNulty, <br />Swift and Mayor Hilton. <br />Councilman Granger moved that the specifications covering the position of Assistant <br />Recreation Director be approved due to the fact that an examination is being held <br />shortly for this position. The motion was seconded by Councilman Swift and passed <br />unanimously. <br />REVEREND HAMMAN OF THE FIRST CHRISTIAN CHURCH appeared before the Council requesting per- <br />mission for the church to build on more than 50% of the lot at the corner of Brew- <br />ster and Lowell Streets. He presented plans and elevation of the proposed structure. <br />It was brought out that there had been considerable objection to the construction <br />i <br />�II of Oa church in this vicinity but it was Councilman Werder's opinion that the Coun- <br />cil could not legally prevent it as the ordinance permitted churches in the first <br />residential district. However, it was necessary that the church conform to building <br />restrictions. Inasmuch as the Planning Commission was to meet the next night the <br />matter was referred to them for discussion and report at the next regular meeting. <br />A MR.
