Building Inspector Duncan advised thata permit for <br />this type of sign must be issued by the Council. Councilman Granger moved, <br />seconded by Councilman Werder, that the permit be granted until,:the first day <br />after .New Years with the understanding that if it has to be removed by the <br />city the cost will be borne by the owner of the sign. Motion passed unani- <br />mously. <br />Mr. Emil Tillman, Eaton Avenue Villas, appeared before the Council in regard to the <br />final map of this subdivision. He was advised that this matter had been re- <br />ferred to the Planning Commission and that no meeting of that commission had <br />been held since the last Council meeting. He was advised,a meeting of this <br />body would be held on December 10. <br />Mr. Anthony B. Doolin, 419 Quartz Street, appeared. before -the Council and presen- <br />ted a petition signed by residents of Blocks 4 and 5, New High School Acres <br />requesting the Council to halt construction'of a.triplex in Block 4 of.this <br />subdivision. Mr. Doolin explained that some time ago a petition had been <br />circulated in this area to rezone the area from second residential to first <br />residential but that it had not been completed. The petition was now com- <br />plete and he,also presented it. It was the opinion of the protestants that <br />the -.construction of the multiple dwelling would be -detrimental to -surround- <br />ing property. Mayor Hilton explained that there was nothing the Council <br />could do to prevent the construction of this building. The zoning ordinance <br />allows multiple dwellings in the second residential district and the permit <br />j had been issued in compliance with -the ordinance. Councilman Armstrong ex- <br />pressed the opinion the city would be inviting a law suit if it attempted <br />to halt the construction. He believed this area should be rezoned to first <br />residential and expressed the opinion that more of the surrounding terri- <br />tory should be included in the petition. A Dr. Musante and Mr. Partidos <br />appeared protesting the erection of the building- In view,of the petition <br />received to rezone this area to first residential district, Councilman <br />Armstrong moved, seconded by Councilman Britschgi, that the Building Inspec- <br />for be instructed to issue no further building permits in the area outlined <br />west of Jefferson Avenue to the city limits that would not be permitted in <br />the first residential district until a recommendation has been received..from <br />the Planning Commission as to the rezoning. Motion passed unanimously. <br />A Mr. L. Lindsey appeared requesting permission to erect a redwood rustic pre- <br />fabricated garage on E1 Camino Real. It would serve as a display for this <br />type of structure. The building does not conform to the regulations of <br />r <br />Fire DistrictI, in which it was proposed to be erected. Councilman Granger <br />was opposed to granting the permit on the grounds that it would be acting <br />as a precedent for display structures on the highway. Councilman Armstrong <br />was unwilling to grant the permit due to the structure being in iriolat.ion <br />of the fire district, and moved, seconded by Councilman Granger, that the <br />permit be denied on the basis that the building does not conform to the fire <br />district.
