1„ <br />I <br />78 . <br />There was further consideration of Simpson Reinhard+s request for a permit to build an auxilliary struc- <br />ture on his lot on Arlington before the main structure was 25% completed. Mr. Reinhard stated <br />that his intention to use it as a shooting gallery on occasions was no longer being considered and <br />that the structure would eventually be combined with the house. There was considerable dis`cussio'n, <br />the consensus of the Council being that it was against the ordinance and there was no way in which <br />a permit could be issued. Councilman Werder moved, seconded by Councilman Swift, that the struc- <br />ture be allowed subject to the requirements of the Building Inspector. Under the question, <br />Councilman Armstrong stated that if it met the requirements of the Building Inspector it need not <br />come before the Council. Councilman Werder, with the consent of the second, withdrew his motion, <br />and moved, seconded by Councilman McNulty, that the matter be dropped from the agenda with the <br />understanding that when 25% of the main structure is complete Mr. Reinhard can construct the aux- <br />illiary structure. Motion passed unanimously. <br />City Attorney McCarthy advised that Mr. Ernest Wilson had reported that he was not ready to award the <br />contract for improvements in Redwood Terrace and that all matters be laid over to the next meeting. <br />Mr. Ludwig Werder, representative of the -Land Development Company, was in the audience and objected <br />to the matter being continued. He advised that the San Francisco Bank would guarantee the bonds. <br />City Attorney McCarthy advised that there should be written assurance that the bonds will be pur- <br />chased before the contract is awarded. City Manager Blom stated that Mr. Ludwig Werder had'ooniaoted <br />him earlier in the day and that Mr. Blom had suggested that the Council might authorize him to <br />sign the contract upon verification from the bank that the bonds will be purchased. He also stated <br />that he believed the Council should specify the proceeds of the bonds. He pointed out that a <br />portion of the assessment is on property not within the subdivision and that most of that propexjy <br />is tax delinquent property of the city. He believed it should be specified whether or not the <br />offer to purchase the bonds included this property or not. City Attorney McCarthy believed assur- <br />ance should be had for the purchase of bonds on this property and further stated that it has al- <br />ways been the policy of the Council not to let a contract until assurance has been had that the <br />bonds will be purchased. Mr. Ludwig Werder asked if the Land Development Company took over the <br />bonds on that property whether the taxes would be a first lien. City Attorney McCarthy advised <br />the taxes would be the first lien and the bonds the. second. Mr. Ludwig Werder, after consulta- <br />tion with Mr. Cohn of the Land Development Company, stated the Land Development Company would be <br />responsible for the bonds on the property outside of Redwood Terrace No. I. <br />There was also a question as to who was to be awarded the contract. Mr. L. C. Smith was the low <br />bidder but Mr. Peter Sorensen had given a better time limit. There was also some question as to the <br />responsibility of the low bidder. City Attorney McCarthy advised that it would probably be diffi- <br />cult to prove that the low bidder was not responsible but that with the consent of Mr. Smith the <br />contract could be awarded to Mr. Sorensen. He stated there would be possibility of a law suit <br />if the bid were awarded to Mr. Sorensen without the consent of Mr. Smith. After more discussion, <br />it was decided to hold an adjourned meeting of the Council next Monday to allow time to get a <br />commitment from the bank as to the purchase of bonds and the assurance of L. C. Synth that he <br />would release the contract. Councilman Granger moved, seconded by Councilman Swift, that when <br />the meeting is adjourned it be adjourned to next Monday, January 13, 1947, at 8:00 P. M., for <br />the purpose of settling the'matter of awarding the contract for improvements in Redwood Terrace <br />No. 1; that Mr. Ernest Wilson be notified to contact the San Francisco Bank to ascertain whether <br />the bonds will be purchased and that assurance be had from L. C. Smith as to whether or not he <br />will relinquish his low bid. Under the question, Councilman Armstrong requested that if Mr. <br />Wilson did not proceed to get the information that the city officials do so. Motion passed unan- <br />imously.
