MINUTES OF -ADJOURNED MEETING 137 <br />REDWOOD.CITY COUNCIL <br />February,.1949, 4:30.P -M. <br />ON ROLL CALL the following were noted present: Councilmen: C. A. Britschgi, Floyd D. <br />Granger, H. E. Holmquist, R. V. Spillers, A. V. Swift, and.City Clerk R. S. Dodge. <br />Also present were: City Manager E. A. Rolison, City Engineer Glenn M. Jain, and <br />Administrative Assistant Richard Miller. Councilman A. H. Morgan, Jr. and Mayor <br />W. M. Werder noted absent. <br />U COUNCILMAN BRITSCHGI was selected to act as temporary chairman on motion of Councilman <br />Swift, seconded by Councilman Granger. <br />CHAIRMAN BRITSCHGI ANNOUNCED the purpose of the meeting which was to reach an agreement <br />with M. J. King Company, regarding water system in Woodside Terrace No.l. Tentative <br />- agreement was read by City Clerk Dodge whereby M. J. King would install the water <br />mains to serve approximately 110 homes to be built, and would furnish a bond of <br />$2000 to cover the installation of an additional 600 feet of main should such a move <br />be necessary to maintain sufficient water supply for the aforementioned 110 homes. <br />LLOYD COSGROVE, Attorney for M. J. King addressed the Council and agreed to meet the <br />requirements of the contract with the exception of a few minor revisions which he <br />and our City Attorney could work over and agree upon. <br />i , <br />After considerable discussion, Councilman Spillers moved acceptance of the agreement, <br />seconded by Councilman Granger who stipulated that his second was subjecttoagree- <br />ment, being approved by the proper authorities, would include the refund of 20% <br />receipts over a period of ten years, and that this agreement would in no way have any <br />• t <br />bearing on future applications for service in any subsequent subdivisions. The maker <br />of the motion included the stipulation in his motion which carried unanimously. <br />Councilman Spillers moved, seconded by Councilman Swift, that City Engineer Jain and <br />City Clerk Dodge be authorized'to sign subdivision map as soon as new agreement was <br />signed,•and the water situation deleted from the original agreement. Motion carried. <br />j� Councilman Spillers offered resolution, and moved adoption, authorizing City <br />Manager Rolison to sign the agreement after necessary redisions were made, seconded <br />by Councilman -Swift. Motion carried on roll call, Councilman Morgan and Werder <br />i <br />noted absent. <br />RESOLUTION No. 677 <br />AUTHORIZING AGREEMENTS WITH M. J. KING, INC. <br />WHEREAS, the City of Redwood City and M. J. King, Inc., after negotiation, <br />have reached an agreement regarding installation of water mains and other improvements <br />in a subdivision known as Woodside Terrace No. I; <br />!= NOW, THEREFORE, BE AND IT HEREBY IS RESOLVED that the City Manager is hereby <br />authorized and directed to enter into two contracts with M. J. King, Inc., embodying <br />in general the following terms and conditions: <br />1. M. J. King, Inc. shall install all improvements at its own expense in <br />accordance with the plans and specifications submitted by it to the City of Redwood <br />City and heretofore approved by the City Engineer. <br />{ 2. M. J. King, Inc. shall provide surety bonds in an amount sufficient to insure <br />installation of such improvements. <br />3. A separate contract regarding a water system to be installed in said Woodside <br />Terrace No. 1 shall be executed providing generally for a refund of twenty per cent <br />f (200) of the gross revenue from the sale of water within that subdivision for a. <br />i period of not exceeding ten (10) years or until the coat of said water system is <br />repaid without interest, which ever is sooner. M. J. King, Inc. shall agree to in- <br />stall an additional six hendred (600) feet of six inch (611) water mains from said sub- <br />division to connect with the existing eight inch (811) main on Woodside Road, should <br />the water supply prove inadequate for the homes to be constructed in said subdivision. <br />4. Other terms and conditions shall be determined by mutual agreement between <br />the City Manager and M. J. King, Inc. '`, <br />
