256- <br />RESOLUTION OF PUBLIC HEARING, VIRGINIA AVENUE, affidavit of publication and posting <br />ordered filed on motion of Councilman Holmquist, seconded by Councilman Swift, <br />and carried. <br />RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY, VIRGINIA AVENUE, was offered and adop- <br />tion moved by Councilman Granger, seconded by Councilman Swift, and carried on roll <br />call. Councilmen Morgan, Spillers, and Mayor Werder were noted absent. <br />RESOLUTION No. 744 <br />RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY <br />VIRGINIA AVENUE <br />WHEREAS, on the 5th day of July, 1949, the City Council of the City of Redwood <br />City adopted a Resolution of Preliminary Determination to make public improvements <br />in the City of Redwood City, being Resolution No. 730 of said Council, to con- <br />struct certain public improvements more particularly described therein, and did <br />fix therein this date as the time and place when and where any and all persons <br />interested may appear and show cause, if any they have, why the City Council should <br />not find and determine that the public convenience and necessity require the <br />improvements described and referred to in said resolution vd.thout compliance with <br />the Special Assessment, Investigation, Limitation and Majority Protest Act of <br />1931; and <br />WHEREAS notice of the adoption of said resolution and of said time and place <br />of hearing was given by the City Clerk by publication and posting for the time <br />and in the manner provided in said resolution and Ordinance No. 515 of the City of <br />Redwood City, as appears from the affidavits on file with the City Clerk; and <br />WHEREAS no persons objecting to the undertaking of said proceedings without <br />first complying with the provisions of said Special Assessment, Investigation, <br />Limitation, and Majority Protest Act of 1931 have filed written objections thereto <br />with the City Clerk at or -before the time fixed for this hearing by persons inter- <br />ested, owning or having an interest in real property within the proposed assess- <br />ment district, bearing their signatures, a description of their property, and a <br />statement of the nature of their interest therein; and <br />WHEREAS all persons have been given an opportunity to be and were fully heard, <br />and said Council has duly considered any and all objections and protests made, and <br />the said proposed improvements and the public convenience and necessity for making <br />the same; <br />NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of <br />Redwood City, as follows: <br />1. That public convenience and necessity require the improvements described <br />in said Resolution No. 730. <br />2. That any and all objections and protests made pursuant to said resolution <br />, and the same are, hereby overruled and denied. <br />3. That the improvements described in said resolution be made under and <br />pursuant to the provisions_of Article I of the Redwood.City Improvement Procedure <br />Ordinance (Ordinance No. 333, adopted March 14, 1932, as amended), and that the <br />Special Assessment, Investigation, Limitation and Majority Protest Act of 1931 <br />shall not apply to said proceedings. <br />Passed and adopted by the Council of the Cit of Redwood City at a regular <br />meeting thereof, held on the 18th day of July, 199, by the following vote: <br />AYES, and in favor of the passage and adoption of the foregoing resolution: <br />Councilmen: BRITSCHGI, GRAIGER, HOLMQUIST, and SWIFT. <br />NOES, <br />ABSENT, <br />ATTEST: <br />Councilmen: <br />Councilmen: <br />NONE <br />SPILLERS, MORGAN, and Mayor WERDER. <br />RALPH S.
