358 <br />PERMITIT()aALLOW A MORTUARY TO BE ESTABLISHED IN THE CHURCH AS A MORE RESTRICTED NON- <br />CONFORMING USE. The Board of Adjustment in denying the application ruled that the use <br />would not be more restrictive and therefore was not allowable under the terms of the <br />Zoning Ordinance. Petitions were filed, 50 against and 10 for the mortuary. Coun- <br />oilman Morgan moved denial of rezoning this area for any use permit for this property <br />for any purpose. other than for which it was established, seconded by Councilman <br />y <br />Spillers. Councilman Britschgi asked about right of appeal and Mr. Lebsack informed Ftj <br />the Council they had a right of appeal within 30 days and if they did not appeal the <br />action of the Planning Commission would become final. Councilman Morgan state the <br />gentleman who came to him wished to have a final decision made at this time. On <br />E <br />4 <br />discussion, with the consent of the second, Councilman Morgan reworded the motion <br />9 <br />that application for change of use permit for mortuary be denied. On roll call i <br />3 <br />vote Councilman Morgan, Spillers and Swift voted Yes; Councilmen Britschgi, Granger <br />z <br />and Holmquist withheld their votes and Mayor Warder voted No because of the legal j <br />ruling allowing applicant 30 days to appeal. Motion was lost due to lack of <br />Majority. - <br />MRS. RUTH ELLIS CROWELL, 325 Alameda de las Pulgas, between Whipple and Hopkins, had.. <br />recently purchased a house from Mr. Argenta and stated that the Building Inspector <br />Mr. Duncan, had informed her according to the ordinance a sidewalk should be <br />installed but claimed that the Engineers office stated they could not give her <br />specifications. City Engineer Jain stated that the Alameda was to be widened at a <br />later date and that they were going ahead on the plans, but rather than let anyone <br />put in a sidewalk and have the expense of relocating it, that specifications were <br />not available at that time. Mr. McCarthy was present and stated he represented <br />Mr. Argenta. Mrs. Crowell was to contact Mr. Jain. <br />MR. HENRY B. BUTCHER APPEARED IN REGARDS TO LEASE ON BUILDING FORMERLY OCCUPIED BY <br />AMERICAN LEGION. Mr. Butcher requested information -as to whether Veterans Build- <br />ing could be leased to the United Veterans Council inasmuch as American Legion <br />had moved out. Councilman Granger stated that in his opinion the building could. <br />not be leased to the Council but the lease would have to be drawn to a recognized <br />veterans organization. Councilman Britschgi moved this b e placed on the agenda <br />for a report at the next meeting by City Attorney Currie, seconded by Councilman <br />Morgan and carried. <br />DR. A. E. O'NEILL SUBMITTED HIS RESIGNATION AS MEMBER OF THE PERSONNEL BOARD TO THE <br />COUNCIL. He had previously addressed a letter to the City Manager tendering his <br />resignation. As he was appointed by the Council it was Mr. Rolison's suggestion <br />F <br />to him that his resignation be made to the Council. Councilman Granger moved <br />that his request be accepted with a vote of thanks for the time he ha'd served on <br />the Board, seconded by Councilman Morgan. Councilman Britschgi thought the Coun- <br />oil should hear his reason for resignation. Councilman Granger withdrew his motion <br />with the consent of the second. Councilman Britschgi moved that Dr. O'Neill and all <br />RLl . <br />interested parties be invited to attend the study meeting on Monday night December <br />12th, seconded by Councilman Swift and carried. <br />KENSINGTON SQUARE, RIGHT-OF-WAY ACQUISITION. City Engineer Jain recommended acceptance <br />of the following deed for widening of Alameda de las Pulgas and Jefferson Avenue. <br />Amount previously offered is comparable 'to that paid. for adjoining property. <br />Figures were based on estimated value of property.
