The said representative is hereby authorized to furnish such information 415 <br />and take such other action as may be necessary to enable the Applicant to qualify for <br />the advance; <br />'5. That the officer designated in the preceding paragraph is hereby designated <br />as the authorized representative of the Applicant for the purpose of furnishing to the <br />United States such information, data and documents pertaining to the application for <br />an advance as may be required; and otherewise to act as the authorized representative <br />of the Applicant in connection with this application. <br />6. Councilman Holmquist moved approval of City Manager to engage the ser- <br />vices of an appraiser as suggested by Attorney Wilson, seconded by Councilman <br />Britschgi, and carried. <br />RESOLUTION No. 835 AUTHORIZING CITY MANAGER ROLISON TO ENTER INTO AGREEMENT WITH THE LAND <br />DEVELOPMENT COMPANY IN REGARD TO WATER MAINS TO BE INSTALLED AT SUBDIVIDERIS EXPENSE <br />refunds to be made at the rate of. 20% of the revenues for a period of 23 years or <br />u#til 60% of the cost has been recovered which ever occurs first, was offered by <br />Councilman Holmquist and moved for adoption, seconded by Councilman Granger and <br />carried on roll call. <br />RESOLUTION No. 835 <br />AUTHORIZING COMPROMISE OF SUIT FILED BY LAND DEVELOPMENT COMPANY <br />AGAINST THE CITY OF REDOOW CITY <br />WHEREAS there is now pending an action in the Superior Court of the State of <br />California, in and for the County of San Mateo, against the City of Redwood City and <br />certain officers thereof, which action is entitled "band Development Company, et al, <br />vs. the City of Redwood City, et al", and is numbered therein No. 49138; and <br />WHEREAS, as a result of numerous conferences between the plaintiffs and defend- <br />ants in said action, a basis for the compromise of the differences as set out in said <br />action .has been agreed upon and it is the desire of the parties to said action to <br />finally settle, adjust and compromise their differences respecting the matters set <br />out in said action; <br />NOVI, THEREFORE, the Council of Redwood City, California, hereby resolves as <br />follows: <br />1. That the City Manager of Redwood City is hereby authorized and directed to <br />enter into an agreement with Land Development Company respecting the matters set out <br />in the complaint heretofore filed by Land Development Company against the City of <br />Redwood City under the following terms and conditions: <br />(a) Land Development Company to install, at its own expense, a water system, <br />complete in place, in accordance with plans and specifications to be approved by <br />the City of Redwood City, said system to be installed in that tract of land now <br />owned by said company commonly known and referred to as the "Carson -Monckton <br />Tract". <br />.(b) City to pay to Land Development Company, out of the gross revenue derived <br />
