Auditor Brophy requested permission to make one correction t due to a clerical error. Councilman Morgan moved approval of Auditor's request, seconded by Councilman Holmquist and carried. CLAIM FOR ALLEGED DAMAGE OF INJURY DUE TO FALL ON JAMES AVENUE in front of Downs Bike and Sport Shop was submitted by Mrs. Heln Miles, 1604 Virginia Avenue. Councilman Werder moved that the claim be denied and referred to the insurance carrier, seconded by Councilman Spillers and carried. TREE REMOVALS ALONG STATE HIGHWAYS WITHIN CITY LIMITS. District'Engineer, B. W. Booker, replied to City Engineer Jain's inquiry regarding a.permit to remove such trees and stated that all requests were investigated and not granted -except in instances where removal was necessary to prevent a hazard to highway traffic ow where it became necessary to remove a tree in order to construct an encroachment authorized by an Encroachment Permit. It would be appreciated by their department if tree removals without permits would be reported to them promptly in order that action might not be delayed. The Mayor ordered the letter filed. 0 PROPOSED TIDE GATE STRUCTURE - REDWOOD CREEK. City Engineer Jain submitted estimate of $41., 910 for this project, plus cost of plans and specifications and construction engineering. It was recommended that plans and specifications be approved, subject w to final checking and that the City Manager be given authority to advertise for bids to avoid further delay and to assure completion of project during the summer months. Councilman Holmquist moved approval of recommendation, seconded by Councilman Granger. At City Attorney Currie's suggestion the motion was amended with consent of the maker and the second, the job to be let out on bid subject to availability of funds. The motion carried. APPOINTMENT OF REAL ESTATE COMMITTEE. Mayor Britschgi appointed Councilman Spillers,.as Chairman and Councilman Werder on this Committee to act with City Collector Perrin. CONDEMNATION LOTS 23 and 21�, Block 42, Central Park, owner Mrs. Lois Montgonery, Recreation Area, Community Park. 'These lots face St. Francis Street and had been under condem- nation for three or four years. Buildings on these lots could be used by the Park Department for storage space for equipment. Councilman Spillers reported that Mrs. Montgomery would like $4000 for the lots. It was the opinion of the Committee that i the City might offer $3500.. Discussion took place with the thought of authorizing City Manager or City Attorney to negotiate on the basis of $3500 in the attempt to consummate the deal or go ahead with condemnation. According to City Auditor Brophy it was nto certain there was enough money in the bond fund for this as all had been included in the swimming pool figure, however the bids on the pool would be enter- tained the following Monday night, May 8th, by the Council and it would be determined at that time whether or not funds would be available for this property. Councilman Spillers had moved that a letter be written to Mrs. Montgomery offering her $3500 for the lot, seconded by Councilman Holmquist and later maker and second accepted suggested amendment by Councilman Werder to write letter after the meeting of May 8th. lMotion carried. it 6
