Motion was seconded by Councilman Granger and carried. The <br />matter was placed on the agenda for the meeting of July 3rd. City Attorney Currie <br />suggested once again that a notice be prepared, which would explain the Councils <br />policy and which would be sent to all home owners and absentee lot owners in the <br />Emerald Lake area. There were some 3000. Councilman Granger moved that a suitable <br />letter be prepared by the City Manager, seconded by Councilman Royer and carried. <br />STANLEY-WESTGATE APPROVAL OF STREET IMPROVEMENT WITH REFERENCE TO PENALTY. City Engineer <br />Jain requested a decision of the Council on this as this project was ready for <br />acceptance and .it was necessary to determine the amount of penalty, if any, to be <br />charged against the contractor for delays or whether the penalty should be waived. <br />He wished to notify the contractor and complete the spread of assessments on the i <br />project. The original completion date was January 2, 1950 and the Council had y <br />t <br />granted an extension of 20 working days plus any delays occasioned by inclement } <br />weather. There were bad soil conditions and they had trouble with the gas lines, <br />etc.! Councilman Spillers moved that the penalty be waived because there were some <br />unusual circumstances connected with the delays on this project, but action was not { <br />to be construed as establishing a policy that penalties would be waived in the future' <br />f <br />as this would not be fair to the people, seconded by Councilman Royer. Motion carrie' <br />Councilman Granger voting No.to indicate that as a general thing he would not be in <br />favor of waiving penalties when a contractor defaulted on the time limit. <br />RENEWAL FOR USED CAR PERMITS. Council- <br />man Spillers moved that renewal of permits be granted, seconded by Councilman <br />Royer and carried. <br />ABATEMENT OF SHEDS REAR OF FIRST CONGREGATIONAL CHURCH, 920 Jefferson Avenue, Lots 1 and <br />9s Block 3, Diller Addition, The Building and Fire Departments reported that these <br />buildings were of old board and batton with no foundation, illegal wiring, adjoined <br />the Church building, were full of old rubbish which constituted a fire hazard. <br />They were in a No. 1 Fire Zone and could <br />not be made to comply. They recommended <br />that the sheds be demolished.
