King, Inc., whereby the City is obligated to reimburse <br />M. J. King, Inc., at the rate of 20% of the gross revenue from, water sales in this <br />area for a period of ten years, but not to exceed 100% of the actual cost of the <br />water system. It was noted that some of the items in the bid covering installation <br />of the water system were as much as 100% over average recent bids for this type <br />work. Mr. Jain therefore recommended that the basis of refunds on the water system <br />installed in this general contract be reasonable unit prices. City Attorney Currie <br />submitted two letters relative to this bid: one from the Elementary School District <br />recommending acceptance of the bid of M. J. King, Inc., the other from M. J. King <br />as follows: "If awarded the contract to do the work of improvement, contained in <br />our proposal of May 14th, on Connecticut Avenue and Washington Avenue adjacent to <br />Goodwin Avenue School; the undersigned; M. J. King, Inc., agrees that he will do <br />such work for whatever sum the Redwood City Elementary School District deposits with <br />the City of Redwood City, as its share of the cost of such improvements. The'dif- <br />ference between the contract price and the amount so deposited will be paid and <br />absorbed by the undersigned. However, nothing containdd herein is to be construed <br />to prejudice any rights we�might have in prior agreements with the Redwood City <br />Elementary School District'. Signed by B. Lusk for the M. J. King Company, Inc. <br />Mr. Lusk appeared personally to confirm the statements in the above letter, stating <br />that actual cost figures will be submitted in figuring the refund basis, and that <br />the priees used in the bid will not be used for refund purposes. M. J. King agreed <br />to abide by Mr. Jain's recommendation. City Attorney Currie has checked various <br />agreements involved and found them to be in order. Councilman Rover moved that thA <br />recommendation of the City Manager and City Engineer to award bid to M. J. King, Inc., <br />be accepted, subject to the statements made by Mr. Lusk and the City Attorneyfs <br />approval of all documents. Roberts of Trio Associates - bid 1700.00 <br />Checks for 10% of the bid price were enclosed with each bid. Councilman Herkner <br />moved that high bid of Richard Sjoberg in the sum of $1800.00 be accepted if found <br />to be in order after checking by City Attorney. Seconded by Councilman Jones and <br />carried. <br />CIRCLE..ROAD IMPROVEMENTS, BIDOPENING AND PUBLIC HEARING. Affidavit of posting, mailing <br />and publication ordered filed, Circle Road Improvements. •Publi.c hearing as set forth <br />in the Resolution of Intention, Circle Road Improvements, was declared open.
