42 <br />with excessive depths., <br />Mr. Joesten stated that they had already considered some twenty requests for resubdivi- <br />sion and had an additional one on the next planLin'gCommission meeting. After general <br />discussion, there being no further protests from the floor, Mayor Granger declared'the <br />public hearing closed and Councilman Britschgi moved denial of the recommendation of the <br />Planning Commission to establish official plan lines through Block "G", Woodside Acres, <br />seconded by Councilman Royer and carried on roll call. Councilman Spillers noted absent. <br />PUBLIC - HEARING, CANYON ROAD SEWERS. Affidavits of mailing, posting and pub ca ion were <br />ordered filed. City Attorney Currie explainedEhat the original assessment had been <br />modified due to reduction of Assessment #14, the amount of $79 being respread adding <br />approximately 0 1 2-50 to each assessment. 1"r. M. V. Ignotm questioned as to whether or <br />not additional assessments would be charged when future storm drains were installed in <br />Glenwood Avenue. Mr. A. H. Bicker appeared for the Engineering Department and stated <br />that no further charges would be assessed against the property in the assesment district. <br />Mr. wm. Will, 806 Canyon Road, signed written protest stating that recent survey had <br />eliminated 3 ft from their property leaving only 47 ft frontage. However, it was ex- <br />plained that the assessment was based on map showing all lots of 50 ft frontage and <br />Mrs. Walls problem was outside the City's jurisdiction. No. further protests being <br />apparent Mayor Grange ordered the hearing closed and Councilman Britschgi moved that 11 <br />protests be overruled, seconded by Councilwoman Tinney and carried. <br />RESOLUTION 1291 CONFIRMING ASSESSMENT WITH MODIFICATIONS AND THE ASSESSMENT DIAGRAM was <br />offered by Coucilman Royer, who moved adoption,,, seconded by Councilman lierkner and <br />carried on roll, call. Councilman Spillers noted absent. <br />PUBLIC HARING ABONDOMENT OF STRIP ON FAIRVIEW AVENUE. Affidavits of posting and publication <br />were ordered filed. Col. D. F. Ewald, 1E51 Fairview Avenue, objected to the house set <br />out and not lining up. with the balance of the houses on the block. He was requested <br />information as to how he would be affected by the abandonment in connection with his <br />fixture. tax bills. Mr. Ben Carson, 435, Fairview Avenue, raised, the same question. <br />Assessor Brophy retired to his office to check:this matter and hearing was postponed to <br />allow Mr. Brophy to.produce the figures. <br />ABATEMENT BUILDINGS 135 BUCKEYE. Mr. J. T. OtKeefe,, Jr. represent the estate advised that <br />the final distribution would be heard in court on July 11th and immediately after this <br />the contract of sale of the property involved would be concluded and the new owner would <br />apply for permit to make the necessary repairs to the house under, abatement proceedings, <br />Councilman Royer moved that the matter be held,over to the 2nd meeting in August (18th), <br />seconded by Councilman Britschgi. Building Inspector Duncan advised that the building <br />can be remodelled. Motion carried. <br />M. MARTIN J. SWEENEY STATED THAT HIS REQUEST FOR BUILDING PERMIT HAD BEEN HELD UP. SUBJECT <br />To A RELEASE BY THE, PLANNING C013TISSION regarding a setback line and possible future <br />widening of Valota Road. He stated he had discussed this matter with three members of <br />the Planning Gonnission and they were willing to remove the restriction -upon his <br />assurance the house would be set back 30 ft fromthe present street line and his agree- <br />ment to deed property necessary for future widening., Mr. Sweeney asked the Council to <br />approve his building permit subject to final action on the part of the Planning Commission. <br />However, he was not willing at this time to agree to the deed of the proerty mentioned <br />above. A?. Sweeney was advised that Council would meet'next Monday, July l4th, at which <br />time final action would be taken. <br />I <br />
