HEARING C014TTNMM - FAIRVIMY AVENUE. Assessor Brophy advised that the taxes onthe 43 <br />properties affected would be subject to tax increase of approximately 60� per year, <br />after which Mrsrs. Ewald and Carson withdrew their protests. <br />RESOLUTION No. 1292. Councilmen Herkner and Britschgi discussed the matter of the one <br />house being set farther forward than other houses in the block and wanted, to know <br />how such a setback line was allowed at the time contract or applied for permit. Coun- <br />cilman Royer offered resolution and moved adoption ORDERING VACATION OF -18 FOOT STRIP <br />ON FAIRVIEW AVENUE, seconded by Councilman Jones, which failed to carry on roll call, <br />Councilmembers Britschgi, Herkner, and Tinney voting No. Councilman Spillers noted <br />absent. <br />On motion of Councilman Herkner, seconded by Councilman Britschgi, hearing was con- <br />tinued to the meeting of July 21st, <br />Mr. T. M. Hoerler, contractor, explained how he had gotten the permit and had checked <br />the setback lines with the -City Engineer's office and after the building was con- <br />structed City Engineer Jain had discovered the house was too close to the City property. <br />He stated further there was a creek on the back of the lot and his house being on a <br />corner lot the setback would be allowed 5 feet closer to the front line than would <br />the houses in the middle of the block. <br />COUNCILMAN ROYER F1AS EXCUSED AIM LEFT THE MEETING at 9.50 P. M. <br />ORDINANCENo. 705 ATZIMING JUVENILE ORDINANCE DELETING SECTION 7. Affidavit of publication <br />was ordered filed. No one present offered protest. Hearing was declared closed and <br />Councilman Jones moved adoption of ordinance, seconded by Councilwoman Tinney and <br />carried on roll call. Councilmen Royer and Spillers noted absent. <br />ORDINANCE No. 706 GRANTING PERMIT TO REINHARD & COMPANY TO MAINTAIN A CLOCK AT 2198 Broadway <br />in the public sidewalk. Affidavit of publication was ordered filed. There were no <br />protests and hearing was declared closed. Councilman Britschgi moved adoption of <br />ordinance, seconded by Councilman Herkner and carried on,roll call. Councilmen <br />Royer and Spillers noted absent. <br />ORDINANCE No. 600.25 REZONING RECENT AREAS ANNEXED TO THE CITY CONSISTING OF CHANGES:FRO15 <br />"U" DISTRICTS TO 11R-1, C -1-H". Affidavit of publication was ordered filed. There <br />were no protests and hearing was declared closed. Councilman Jones moved adoption of <br />ordinance, seconded by Councilman Britschgi and carried on roll call. Councilmen <br />Royer and Spillers noted absent. <br />REPORT ON BID OPENING SALE OF LOTS 16, 19, and 26, Block 2, STAMBAUGH STREET ADDITION. <br />Affidavit of publication was ordered filed. Trio bids were received, one from Mr. <br />Simon Peters, 1E60 Avenue del Ora, for 50650, and one from Mr. Leo Cafferata, 536 <br />Maple Street, 01050. It developed that the lots in question were of 25 foot width <br />and 11r. Peters advised he had purchased Lots 15 and Mr. Peters advised he had pur- <br />chased Lots 15 and 17 which would make a 50 ft. building lot if he were awarded the <br />purchase of these two lots. Lot 19 being a corner lot was A ft. in width. After <br />considerable discussion, Councilman Britschgi moved that the matter be placed on the <br />agenda for the meeting of July l4th to allow City Attorney Currie to check into the <br />matter, seconded by Councilman Jones and carried. <br />RESOLUTION No. 1293- City Attorney Currie advised this was a release of an easement of no <br />interest to the City, furthermore that Pacific Gas and Electric Company and Pacific <br />Telephone and Telegraph Company had advised they no longer had an interest in this <br />matter. Councilman Jones offered resolution and moved adoption to ABAIM014 EASEMENT <br />
