r
Dear Mr. Lebsack:
I have before. me. your letter of November 8th, in which you
state it is the opinion-of.your.office.that the Redwood City
Council..legally. had .autho.ri.ty. t.o.. award.,the .above -indicated
mining -lease.- in .the..manner..in.. which .i.t-.did,. to A. F. Oddstad,
Jr.
Perhaps I do not -clearly _ understand. the terms and conditions
under which.ths. ward..was made.,. and.as..yo.u, make no comment. on
the ques.tions..raised in.. our .telegram of November 4th, in which
we ask three.questions.as, to. whether_.you.were,not in violation
of the provisions.of your -Charter, the praviaions of the State
Municipal Code,, as well._as.1n.violation... o.f..the; well establish-
ed laws. relating..to..b.ids, .I -wonder., if..you. would not have the
patience. to .explain, to, me the authority -possessed by the City
Council...which..suparsedes.-well..defined._regul.ations and long
established law.
In.the absence .of -further comment from..your office, I will
continue..'to believe.that. the illegality and inequity of the
.last.minute procedure of..the.Council.in.making the award to
A. F. Oddstad, Jr., is. perfectly. clean and in extreme bad
faith and a fraud.against.our..Company and -the other bidders.
Hence.,. on ..the.. record as. known to us, . we .can_.do no less than
to accomplish.a.judialal.r.eview of.the Council's action in
_ this matter.
I might add.. that we. have. received several..communications from
residents. .of ..R.edwoo.d.Xi_t.y, .who . are highly. critical of the
Council.'.s_.action. . Among. ... other commentswe-have received, on
which -particularly disturbs me is to the effect that both you
and Mr. Currie are said.to be on the Oddstad payroll and have
for a long time. represented him and certain.of.his corporations.
If that representation is so, it raises mapy questions, for
such a dozyarrangement can hardly be justified unless everyone
concerned. subscribes .t.o. what .might. appear.. -to be the present
Republican dome,firs.t..publicly.enunciated..b.y Secretary Wilson,
that, "What i.s. goo.d.for, Oddstad. is .go.od.f.dr, Redwood City%
In any. event,. 1t. would. appear. that this.. whole..matter should not
only be .subject to .a, judic.ial._ revi.ew.'.-..which we shall seek
at an appropriate..time_-.but that some manner. .of public hearing
would be desirable-in_the-public interest. .
Very .truly yours,
G. A. NUGENT
President"
I
Counc.ilman.Granger to.ok.exce.p.tion..t.o.the.paragraph.wherein.Mr.. G. Nugent stated that he
had received.several.,communicstions from residents of Redwood City, who were highly
critical of the Council's action. Councilman•.Granger was of the opinion that any citizens
who did not agree with the Council's action should notify the Council.of..their objections
and not complain..to..the..Indian.Monumeat .Corp.orati.on... Under.the circumstances of the so
called comp.laints,..C.ouncilman Granger choseto ignor.e..them .as such. City Attorney Currie
• _ stated he. had ..answered Mr. G. A. Nugent's letter, and he wanted it understood that his
office, at no time, has acted as attorney for Mr. A. F. Oddstad Jr. in any matter con-
nected with the City of Redwood City. This was followed by general discussion.
R. L. WALKER REQUEST RECONSIDERATION REQUES.T.TO MOVE .BUILDING. TO. CORNER SPRUCE AND SHASTA,
The Clerk. read .the letter wherein Mr. Walker. appealed....for..reconsideration. of the Council's
action in..regard-to moving, of. a building from..Santa...C.lara to Redwood .City. This building
is . in.e xcellent .condition..aad .is. to -be .used. solely. for, an..office.. to. govern the sale of
red cedar shingles,.and..shakas. It will,conform.to..all requirements of.the Fire, Building
