Mr. Harry <br />Smith, representing Mr. Lindgren, presented the Council with plot plans as requested at the Council <br />meeting of December 5th. Mr. Smith discudsed the new plans at some length. Councilman Spillers moved <br />that the public hearing be closed, seconded by Council -Ulan Britschgi and carried. <br />I, <br />Councilman Spillers moved approval of the application to resubdivide, seconded by Councilman Stout. <br />Councilman Britschi asked that the maker of the motion please make it clear that this is based on the <br />new plans as presented with, one house facing Edgewood Road and one facing on Stratford Street. Council- <br />man Spillers agreed to the change. Councilman Granger stated that he still wanted to know wanted to <br />know what the Council intended to do in regard to the property across the street as far as allowing <br />further resubdivision of lots in the Future. The City Clerk stated that item #11 on the agenda would <br />probably -answer Councilman Granger's question. Item #11 is a request from the Planning Commission <br />asking for further time to consider firm line beyond which no further resubdivision will be allowed on <br />Edgewood Road. This was followed by discussion after which the motion carried on roll call with Council- <br />man Granger, Jones and Mayor Herkner voting No. <br />PUBLIC HEARING, PLANNING COAWISSION DENIAL OF USE PERMIT TO MRS. H. HARELSON TO OPERATE HOME FOR ELDERLY <br />AMBULATORY PEOPLE AT 1055 BRES7STER AVENUE. Affidavit of mailing was ordered filed. The Clerk read <br />the Planning Commission's letter and also the letter from Mrs. Harelson wherein she stated that she <br />had been denied a use permit for a home for elderly ambulatory people and she would like to appeal <br />this decision. Mrs. Harelson stated that there were 10 rooms in the house, 6 being bedrooms, and she <br />further stated that there would be 9 people living there. Mrs. Harelson said that the property was in <br />C-1 zone. <br />When questioned by the Council, Building Inspector Kreiss replied that this building could not comply <br />with the fire zone regulations for a C-1 zone. City Attorney Currie stated that if this is a 0-1 <br />district then it whould not be brought before the Council. -Mr. Conrow stated that the property in <br />question was in a C -1 -F zone which required that Use Permit be issued. This was followed by discussion <br />after which Councilman Royer moved that the public hearing be continued to the first meeting in <br />January -with the proviso that the departments involved bring in a report as to the condition of the <br />building, seconded by Councilman Stoat and carried. Councilman Granger stated that the State should <br />also be notified. There being no protests, written or <br />oral, Councilman Spillers moved close of public hearing, seconded by Councilman Jones and carried. <br />Councilman Jones offered ORDINANCE 600.65 RE70NING PORTIONS OF AREA BOUNDED BY ALDEN STREET, BAYSHORE <br />HIGHWAY, MIDDLEFIELD ROAD, BRADFORD, AND WARREN STREET FROM R-4 TO C -1 -H -F DISTRICT and moved its <br />adoption, seconded by Councilman Spillers and carried on roll call. <br />PUBLIC HEARING, ADOPTION OF ORDINANCE ESTABLISHING FIRE ZONE NO. 1 IN SAME AREA. Affidavit of publication <br />was ordered filed. There being no protests, Councilman Britschgi moved that the public hearing be <br />closed, seconded by Councilman Spillers and carried.
