496 LETTER FROM THE PARK AND RECREATION C01414ISSION REAFFIRMING THEIR PREVIOUS POSITION REGARD- ING STULSAFT PARK, PHASE ONE. Councilman Stout moved that this item be taken up at the budget study meeting, seconded by Councilman Weiss. Councilman Granger stated that he did not think this was a budget study issue. He thought this could be taken up at a regular study meeting. Mr. Jain stated that they would probably have the plans completed within the next couple of weeks on the first phase. The Recreation Commission has not seen the plans as yet. This was followed by discussion in regard to whether or not this should be considered at a budget study meeting. The motion carried with Councilman Granger voting NO - LETTER OF APPRECIATION, MR. T. LOUIS CHESS, GENERAL PASSENGER AGENT, SOUTHERN PACIFIC COMPANY. The Clerk read the letter. Councilman Stout moved that the letter be field, seconded by Councilman Granger and carried. PETITION REGARDING WATER DEPARTMENT INDEBTEDNESS. The Clerk read the petition, 15 signatures, which reads in part as follows: "....Therefore, we the undersigned citizens and electors of Redwood City petition your honorable body to take action at the earliest possible date as would cause a complete and factual legal determination to be made of all actions pertaining to and involving such indebtedness for, by and on behalf of the Redwood City Water Department and the City of any and all transactions, agreements, etc. leading thereto. Further, that a complete,resume of all matters pertaining thereto and final determination of their legality and propriety be made public through the press as soon as practicable." Councilman Weiss moved that the entire matter and related questions affecting the Water Department indebtedness which is the subject of this petition be referred to the City Attorney for exploration, determination of legal questions and problems involved, and that he submit his opinion as to the validity of any and all matters involving the Carson -Monckton, Land Development and other water deals with the City, and in the event the press of other matters or current work in his department is of such volume as would prevent his giving this matter reasonably diligent and expenditious attention, he sub- mit suitable recommendation of other means of approach to the problem and as will per- mit an early and proper determination and action to resolve this question once and for all, seconded by Councilman Stout. Councilman Granger stated that he did not think that the statement is true that the City is indebted to the sum of §300,000 as stated by Councilman Weiss. Councilman Weiss differed with Councilman Granger in the fact that he believes that this is an indebtedness to the City. Councilman Stout stated that he wanted to reiterate his previous statement that he seconded this motion so it will clear up the matter once and for all. This was followed by discussion after which I the motion lost on roll call vote with Councilmen Granger, Herkner, Spillers, Weymouth and Mayor Royer voting NO. Councilman Herkner moved that the City Manager come in with a written report to the Council and to the Press giving a full statement as to the reason for the agreement with the several companies and the action taken by the Council and the fact that it was,'approved by g com legal council at the time and the,romise was.to�the benefit to. p the City, seGonde.d by'Councilman Spillers. Councilman Weiss stated that this matter was brought up because of the previous report made1by the-Cit.jr,:Manager and he di& not believe that the City Manager was the proper authority to make the report.
