N <br />i <br />5 <br />The question arose as to what a floating deed represented and why the City could not <br />obtain a regular deed for the street. Herb Frahm, engineer representing Oddstad Homes, <br />.stated that the reason a floating deed was given at this time was that it takes time to <br />determine the alignment of the street. By giving the City a floating deed, the City will <br />have the right to set an 80' easement wherever they choose, and after the completion of <br />the alignment then a regular deed will be.given the. City. This was followed by consider- <br />able discussion after which 'Councilman Granger moved that the Council accept a copy of the <br />preliminary report and it be made a part of the record, seconded by Councilman Stout. <br />Councilman Britschgi wanted to know what was going to happen to the water during the peak <br />of the run-off season.. The Mayor ruled the question out of order as it had nothing to <br />do with the present motion. Councilman Granger was asked to resate his motion which was <br />that a copy of the map, which had been presented earlier in the meeting showing the pro- <br />posed Farm Hills Blvd., be turned over to the City Clerk as evidence of good faith, and <br />the Clerk in turn would turn it over to the City Engineer for checking and study. Motion <br />carried on roll call with Councilman Britschgi voting NO. <br />Councilman Jones brought up the question of whether or not fees should be charged for <br />annexation or subdivision rights. The Mayor asked that the City Attorney maks a written <br />reports as to whether or not the City can or connot charge a f ee for property already in <br />the City. The Attorney stated that a distinction must be made as to whether this is a <br />subdivision fee or an annexation fee. Councilman Stoutwas of the opinion that this <br />should be considered as an annexation fee. Councilman Spillers stated that the property <br />owner has been paying City taxes for the past seven years as a part of the Carson -Monckton <br />Tract. <br />I ' <br />Councilman Britschgi stated that his question was what was going to happen to the water. <br />Is it going to be dumped into Stulsaft Park? Mr. Frahm stated that about 50 to 60% of <br />the water is carried toward Stulsaft Park. .City Engineer Jain stated that the creek is <br />the natural channel for the water -to drain.., He statedthat he didn'tknow what else the <br />City could do to take care of the water as it was his belief that about 80% of the water <br />will drain toward Stulsaft Park. This was followed by considerable discussion after which <br />Mr. Frahm stated that he thought that perhaps an 8' x 8' box with a.filter could be built <br />at the end of each drain pipe emptying into the channel. which would help to clean the oil, <br />etc. from the water emptying into Stulsaft Park. Mr. Frahm suggested that his company <br />and the City Council meet and discuss this before accepting the second unit. Councilman <br />Stout was of the opinion that this should be made a condition to the Planning Commission's <br />recommendations. Councilman Royer asked that the Council make this a condition to the <br />second unit. <br />Councilman Royer moved approval of the Planning Commission's recommendation with the <br />addition of item #12 (approval of the Farm Hills Boulevard map) to the conditions, <br />seconded by Councilman Spillers. Councilman Britschgi stated that the Council had agreed <br />that no one could move into these homes before the road was finished. Mr. Wells stated <br />that no one could move into these homes before the road was finished. Mr. Wells stated <br />that the only condition he asked was that the City have all the deeds and full approval <br />'of the City Engineer for the plans and specifications. He asked that the street be <br />completed by June 1st. City Engineer Jain asked that the sanitary drainage be approved <br />before the submitting of area ##2, approve Farm Hills Boulevard as well as the streets <br />entering same.
