Councilman Herkner asked if there was any other way
they could do this. The answer was that they had to take some action either to pro-
ceed or deny the annexation. HOWELL, HEALTH DEPARTMENT, REGARDING SERVICE STATION UNDER CONSTRUCTION AT OAK KNOLL
AND CANYON ROAD. The (Clerk read the following report submitted by Mr. Howell:
In reviewing the minutes of the regular meeting of the Redwood City City Council
for July 1, 1957 it was noted that Councilman Weiss had submitted some specific
questions regarding a service station that is being constructed at Dak Knoll and
Canyon xoads in the Emerald Lake area. I believe that I might submit data that
will clarify.some of these questions.
1. The owners of this property filed epplication for rezoning of the property
with the County Planning Commission in November, 1956• The first hearing
on this rezoning application was on Dedember 19, 1956. The County Planning
Commission sent out notices to twenty property owners in the surrounding
area and also notified the Redwood City Planning Commission of this proposed
rezoning. At the January 16th meeting of the Planning Commission this
application was denied. The owners appeared before the Honorable Board of
Supervisors and at their hearing, the Planning Commission's action was over-
ruled and the property rezoned. This action in rezoning the property would
now permit the construction of a filling station. The percolation tests at
the sit6 were unsatisfactory. These findings were the same as has resulted
from a previous study at another location at this same road junction when
another oil company desired to build a service station. In view of our
findings, this department asked.the Tidewater Associated Oil Company to sub-
mit their plans along with certain stipulations regarding the proposed oper-
ation and as a result of these agreements the health department approved the
issuance of their building permit on April 22, 1957•
As long as water service to this property existed, there was no legal way
of preventing the oil compahy from continuing to use this water servide.
2. The oil company indicated that they would apply immediately for annexation
to Redwood City and would diligently pursue the same.
3. That until such time as it was possible to obtain an adequate sewer connection,
there would be no cars washed at the station. They agreed that should the
septic tank not operate satisfactorily, they would shut down operations.
