Item No. 7 (continued) <br />In response to question, Planning Director Patterson said that he issued a <br />use permit with certain conditions to allow parking of recreation vehicles on <br />the property, stating it is common practice for the PG &E Company to allow <br />such use where there are power line easements and that the Plan Review <br />Committee, including representatives of the Fire Department, approved the <br />plan. <br />Mayor Claire declared the public hearing open at 8:27 p.m. <br />Mario Biagi, 1556 Hudson Street, rpresenting the applicant, referred to <br />previous Council approval to fill the remainder of the property, and install <br />a pipeline and pump station (see RESOLUTION NO. 10419, 2/2/87). Mr. Biagi <br />noted that the applicant's deed contains an exclusive right from PG &E to use <br />the easement; that on December 15, 1987, BCDC confirmed by telephone that <br />they do not have any jurisdiction; and that the matter is currently before <br />the Corps. He urged approval of the proposed ordinance. <br />Ralph Nobles, 3720 Country Club Drive, member of the Planning Commission, <br />referred to his December 14, 1987 letter to the Planning Commission urging <br />preservation of wetlands and opposing the proposed rezoning. Mr. Nobles <br />suggested the applicant should be required to obtain an Army Corps permit <br />before Council considers the matter and questioned the issuance by the <br />Planning Director of the use permit for parking of recreational vehicles on a <br />portion of the property. <br />In response to question, Mr. Patterson said that the Army Corps regards <br />itself as the final authority and requires Council action before the Corps <br />will consider the matter. <br />Mr. Schricker observed that the only question before the Council is rezoning <br />of the subject property, noting that determinations relating to wetlands and <br />fill must be made by the agencies which have jurisdiction to do so. <br />Mayor Claire invited anyone else who wished to speak to do so.
