I. All written communications from the DB to the City shall be submitted to <br />and through the City's representative. <br /> <br /> m. The DB shall cooperate with the City in the performance of the Work and <br />shall be available for consultation with the City at such reasonable times with advance notice as <br />to not conflict with the DB's other responsibilities under this Agreement. <br /> <br /> n. The DB shall perform the Work in accordance with the Contract <br /> <br />Documents and any order, instruction, direction, interpretation, or determination issued by the <br />City's representative by Addenda to this Agreement. <br /> <br /> 0. Review and Concurrence of any Work of the DB under this Agreement <br /> <br />shall not relieve the DB of responsibility for the professional and technical accuracy and <br />adequacy of the Work. <br /> <br /> 2(b)3 Geotechnical and Survey <br /> <br /> a. The City has provided the DB with geotechnical information, Phase I <br /> <br />Environmental Assessment, a legal description, and a certified land survey of the Project site. <br />Any additional measurements, verifications or supplemental geotechnical or land survey <br />services necessary for the DB to complete its design and construction services are the <br />responsibility of the DB. <br /> <br /> b. The DB shall verify the location and depth (elevation) of all utilities and <br /> <br />services before performing any excavation work. <br />2(b)4 Regulatory Requirements <br /> <br /> a. The DB shall comply with all codes, laws, ordinances, and regulations of <br /> <br />all federal, state, and local agencies having jurisdiction over the Project, and specifically the <br />requirements of the Americans with Disabilities Act, as those codes, laws, ordinances, and <br /> <br />Agmt-247 <br />Flsh/sh/RCICouncil <br /> <br />FXS:rg <br />03/29/99R;O4/OS/99R, 04/07/99R <br /> <br /> <br />
