Item No. 4 (continued) <br />Affidavits of Mailing and of Posting are on file. <br />Building Official LaTorra, Building Inspector Schnell and Albert H. Davies, <br />owner of the subject property, were sworn with regard to testimony to be <br />given during the public hearing. <br />Mr. LaTorra presented the subject report and recommended that the hearing be <br />continued for 30 days in view of the progress made by the property owner with <br />regard to repairs to the building during the past week. In response to <br />questions, Mr. LaTorra said that it is possible to complete repairs to the <br />building within 30 days, if there is due diligence on the part of the owner. <br />He reported that only two of the five units in the building have been <br />inspected and that the permission of the owner or a court order would be <br />required to complete the inspection. <br />Mr. Schnell presented slides depicting conditions of the building which <br />prompted the subject abatement of nuisance action. <br />Mr. LaTorra said that a report was received today from the County Health <br />Officer and City Attorney Schricker stated that the report is a part of the <br />record. <br />In response to questions of Mr. Schricker, Mr. LaTorra and Mr. Schnell said <br />that inspections for rats, cockroaches and other vermin were done by the <br />County Health Department which found infestation; that one of the inspected <br />apartments is now vacant and being repaired; that the gas leak problems with <br />water heaters has been corrected to the satisfaction of PG &E; that sanitation <br />is improved but still not minimal; that the tenants do not have heat from <br />fixed appliances as required; and that the Building Department would prepare <br />a schedule of priorities for repair to be undertaken immediately and <br />completed within 30 days. <br />Mayor Claire declared the public hearing open at 8:40 p.m. <br />Albert H. Davies, 848 Arlington Road, owner of the subject property, said his <br />failure to meet in January with the Building Official was because of his <br />error in placing the matter on his calendar and not intentional. He said <br />that the tenants are responsible for the damage and do not report it to him; <br />suggested the gas leak problems were exaggerated; and that the units are <br />being occupied by more than the number of persons to whom the units are <br />rented, creating excessive damage to the property through heavy use. In <br />response to questions, Mr. Davies said that he serves as building manager <br />and suggested that there is nothing wrong with the plumbing except what may <br />be caused by City tree roots in sewer pipes. <br />Mayor Claire invited anyone else present who wished to speak to do so.
